The Labor Court accepted the request of the Espírito Santo State Teachers Union (Sinpro) and decided to suspend the return of face-to-face classes in private schools, which was allowed to happen as of next Monday, October 5.
The decision was made this Wednesday afternoon (30) by judge Alzenir Bollesi de Pla Loeffler, of the Vitória Labor Court 13, who affirmed that he understood the need to return to school activities, but “that has not been proven, until now, that all the measures taken had the involvement of the different classes involved: teachers, student representatives, other workers in the educational network ”.
Therefore, according to the judge’s ruling, “it does not provide sufficient legal certainty that in five days from now everyone will be returning without proof that all the measures have indeed been taken and that, over time, they will continue to be complied with. “.
The magistrate argues, for example, that there is no creation of a supervisory board of the measures to be taken by schools. In addition, he adds that the school environment translates into crowding, which is not advisable in the context of the new coronavirus pandemic.
“Who will supervise?”
“It should not be forgotten that the activity of going back to school, even if it is limited to 10 students per classroom, in the case of early childhood education, implies overcrowding. Although there is no crowding in the classroom and social distancing is respected in the classroom, there may be crowds at the arrival and departure times of students and also during class breaks (“recess” periods). Who will supervise? The educational institution itself or a council made up of several representatives, or the government? How is this going to happen? ”Asks the judge.
In view of these points, Judge Alzenir Loeffler partially granted guardianship and ordered the suspension of face-to-face classes in private early childhood, primary and secondary schools until the measures determined in the state decree are confirmed.
In case of non-compliance, by the State Government and the Union of Private Education Companies of the State of Espírito Santo (Sinepe), the fine is R $ 50 thousand per day, limited to R $ 500 thousand per establishment.
It is worth mentioning that the return of face-to-face classes on the state network is scheduled for October 13.
Union president says there is no security
The president of the State Teachers Union, Juliano Pavesi, affirmed that the category considers that there is no security to return to face-to-face classes at that time. “Who is going to check if the schools are following the protocols?” He asked.
According to him, the risks are great, as teachers use public transport every day, and many do not inform schools that they have some type of comorbidity for fear of being fired.
“We have to defend life. Why go back to school with two months to finish the year? Schools and teachers are already adapted to distance education ”.
