Judge Marcia Dalla Déa Barone, of the Fourth Chamber of Private Law of São Paulo, denied José Carlos Peres’ new request for protection after the dismissal of the presidency of Santos, last week. The magistrate saw no urgency in the action.
Peres sued the court with “antecedent precautionary measures” after the Deliberative Council opened an impeachment process. The first precautionary measure was denied by Judge Daniel Ribeiro de Paula, of the XI Civil Court of Santos, last week.
This Monday, once again, the request was denied by the magistrate of the State Court of Justice.
The judge did not accept the nullity of the outcome of the Deliberative Council and said that she did not find any legal assumption that indicates urgency to anticipate Peres’s request to retake the presidency of Santos.

– In a superficial analysis, there is no illegality in the procedure that culminated in the temporary removal of the aggravating factor from his functions as president of the club in question. 303/361 – says part of the decision.
– There is also no danger of damage or risk to the useful result of the process that justifies the immediate renewal of the aggravating circumstance to the position from which it was temporarily removed – added the judge.
While seeking to revoke the Council’s vote through Justice, Peres must present his defense at the club before October 13. If the Committee of Inquiry and the members of the board of directors ratify the suggestion of impeachment, the associate will decide whether or not to definitively leave the president within 60 days.
The election of Santos is scheduled for the first week of December. José Carlos Peres and Orlando Rollo, acting president, are not candidates for reelection.
