The federal judge of Court IV, Cláudia da Costa Tourinho Scarpa, determined that the Minister of Economy, Paulo Guedes, must pay R $ 50 thousand for collective moral damage when comparing public servants with “parasites”, in February.
The minister must pay the amount to the Federal Police Union of Bahia (Sindipol BA), the party that filed a lawsuit against Guedes, who may still appeal the decision.
“In the situation described above, the Minister of State for the Economy, in exercise of his right to freedom of expression, insulted public servants. He compared them to ‘parasites’, asked them’ not to attack Brazil, when the giant is on his knees’ and told them to stay at home ‘with a full fridge, ”said the judge.
The judge determined the payment of R $ 50 thousand, “For the violation of the rights of the personality of the members of the professional category represented by this union, through their pronouncements.”
According to Sindipol BA’s lawyer, Dr. Marcel Santos Mutim, “even before the sentence, the Federal Public Ministry had already issued an opinion in the sense that Paulo Guedes’s statements had a generalized discriminatory content, which made the MPF opinion sentence, which was confirmed in the sentence ”.
The president of the union, José Mário Lima, said that justice was served, “in the face of this absurdity committed irresponsibly by the minister.”
“Any citizen, regardless of power or financial level, should receive a proper reprimand when he is wrong. The law is for everyone, ”he said.

According to the union, the amount of the sentence will be donated to the Santo Antônio Hospital, which belongs to the Irmã Dulce Social Work (OSID), and to the Aristides Maltez Hospital, non-profit institutions in Salvador that are at the forefront in the fight against the new coronavirus pandemic.
It is worth mentioning that the court’s decision there is still appeal. Minister Paulo Guedes did not speak.
Understand the controversy
In February, the Minister of Economy, Paulo Guedes, compared public officials to “parasites”, commenting on the administrative reforms that the federal government was seeking.
Guedes specifically criticized the annual salary increase for civil servants, who, according to him, already have the privilege of job stability and “generous retirement.” In addition, he argued that the public machinery, in the three spheres of government, is not financially supported by fiscal issues and, therefore, it is necessary to review the civil service career.
On the subject, he said “The host is dying, the guy has become a parasite, the money does not reach the people and he wants an automatic raise.” He delivered this statement at a conference at the Brazilian School of Economics and Finance of the Getúlio Vargas Foundation (FGV EPGE) at the end of a seminar on the Federative Pact.
According to the minister, his criticisms are shared by Brazilians. “The population does not want this [reajuste automático do funcionalismo público]. 88% of the Brazilian population is even in favor of firing officials, ”he said. Guedes was referring to a Datafolha survey, published in January 2020, which indicated that, for 88% of those surveyed, the official who does not do a good job should be fired.
“In the United States, there are four, five years without adjusting, and when it happens, everyone says ‘oh thank you.’ Here the boy is bound to give [reajuste] because it is sealed and it still bears nicknames, an egg, you cannot fly by plane ”, the minister continued.
