The Pernambuco Labor Court accepted, on Monday (5), the request of the Pernambuco Teachers Union (Sinpro-PE) to prevent the return to face-to-face classes in private schools in the state. The union filed a public civil action, last Friday (2), requesting the revocation of the return of face-to-face classes in the state. According to Sinpro-PE, the lawsuit was filed “to preserve the right to life.”
In the decision, Judge Hugo Cavalcanti Melo Filho determines the suspension of the resumption of face-to-face activities in the private educational establishments of Pernambuco, until the government proves before a court that it has verified, through effective control, the adoption by said establishments, of the measures imposed by protocol of resumption. The magistrate also demands that the State “inform the schools of this decision, that they refrain from resuming classroom activities.”
According to the judge, the State must also, through an act of the Executive Power, define a “risk group”, based on parameters established by the World Health Organization (WHO), and “determine that private schools abstain from convene face-to-face activities of the teachers that make up the group, ”says Hugo Cavalcanti, from the 12th Vara do Trabalho do Recife, in the document.

The order with the decision was sent to the Attorney General of the State of Pernambuco (PGE). The government has, according to the decision, a period of 15 days to present a defense. The president of the Teachers Union, Helmiton Bezerra, affirmed that the public civil action is not aimed at preventing classes, which must be kept at a distance. “We are concerned about keeping classes, but remotely. We will monitor compliance with the action, reviewing complaints and checking possible irregularities,” he said.
State strike
The strike was considered illegal by the Court of Justice of Pernambuco, but the teachers decided to continue the strike by 82.5% of the votes, against 14.6% for the total resumption and 3.3% for the abstentions.
In the first stage, back to school involves only the third year of high school. There are no dates yet for the resumption of basic education and early childhood education. The return will be optional and it will be up to the parents or students over 18 years of age to decide whether or not to attend the classroom activities. The distance learning model should continue to be offered.
The resumption scheduled for this Tuesday involves 91 thousand students. This is the number of third-year high school students in Pernambuco, according to the 2019 edition of the School Census, from the Ministry of Education (MEC). In the entire high school there are 335 thousand students. Basic education in Pernambuco has 2.1 million students.
