A judicial decision freed a man and two women, arrested last Friday (23), in the interior of São Paulo, who were transporting 133 kg of marijuana in a car. The judge who ordered the release of the trio did not accept the arguments of the police and even criticized the approach of the PM.
In addition to Fredson Carvalho de Lima, 35, and Juliane Sabrina Tavares de Souza, 22, the police arrested Suzana Nogueira da Silva, 35, and sent two children in the car to the Guardianship Council, according to the version of military police and investigation. by UOL.
Also according to the PM, the one-year-old boy is Fredson’s son and the three-month-old girl is the couple’s daughter. The police allege that the suspect confessed to having knowledge of the drug in the vehicle and that he would receive R $ 15,000 to take the shipment to Ribeirão Preto, in the interior of São Paulo, but denied that the women had knowledge of the drug. When testifying before the civil police, all detainees reserved the right to remain silent.
At the time of the approach, the police said that the drug was inserted in the seats of the vehicle and under the carpet, in addition to the “unbearable smell” of the place. The driver also displayed behavior seen by police as “a certain degree of nervousness.”
Judge’s decision
According to the decision, Judge Marcílio Moreira de Castro, of the Araçatuba District, demanded the release of the three suspects, since, according to him, the trio was detained in “flagrant illegal detention, for not complying with the requirements established in the legal system”.
In addition, the judge criticized the approach of the police and that the verification on the vehicle could only have been carried out with a search warrant.
“In their testimonial statements, the police did not clarify what the alleged ‘degree of nervousness’ would consist of. They didn’t even say if there would be too much or too little nervousness. Just a generic ‘degree of nervousness’, ”Castro wrote.
To support the arrest, the police also detailed that organized crime has used cars similar to those of a family to avoid suspicion.
“This statement is of great concern to this Court. From the statements of the Police it is clear that the Military Police would be attending, that is, stopping, conducting a personal search and registering cars with entire families inside, with superficial and tenuous foundations, ”he said.
“It would be enough for any member of the family to show a generic ‘degree of nervousness’ and the police would order an arbitrary stop and then informally question the occupants of the vehicle about where they came from and where they were going,” Castro added.
“Brazil is a democratic republic, the police, under minimal suspicions of a subjective nature, cannot detain a whole family on a public road, in a car, and ask invasively where they come from and where they are going,” he concluded.
The repercussions of the case led the São Paulo Justice to again order the arrest of the trio. However, to date, the suspects have not yet been arrested.
