Judge Rudson Marcos, responsible for the Mariana Ferrer case, asked the Department of Internal Affairs of Santa Catarina to present the disciplinary complaint that was presented to him. The magistrate claims that the video of the hearing, published by Intercept, was “highly manipulated.”
According to him, the contents disclosed are “fragments of procedural acts” referring to two instructional hearings, “which together add up to about 300 (three hundred) minutes in length, and which were fragmented and joined, using editing and manipulation techniques.”
Marcos details that, during the hearings, he made 37 interventions during the speeches of the prosecutor, public defenders and accused defense attorney André de Camargo Aranha. On the second day, when only the lawyer Cláudio Gastão da Rosa Filho spoke, there were 14 interventions.
Attached in his defense is a technical opinion prepared by the expert Wanderson Castilho, with the conclusion that the video was “deliberately edited and manipulated several times”, that the lines of the magistrate and the prosecutor “were suppressed” and had their original order. “Deliberately altered, for the purpose of misleading viewers.”
The magistrate points out that “in the sentence handed down in the file the expression ‘culpable violation’ is not mentioned”, coined by the report. “In this context, there are no elements that justify the initiation of a disciplinary process against the Defendant Magistrate, so it is required to receive this information, with the accompanying documents, in order to promote the presentation of this Disciplinary Complaint” , writes. .
