In the order, Judge Moreira stated that the alleged corruption could not be configured, since Lula was no longer president at the time of the events, the PT left the presidency in 2010.
Furthermore, the allegation that Lula acted to mediate in Odebrecht’s relations with the Dilma government would also be “generic,” according to the judge. The judge’s position followed a statement from the Federal Public Ministry, which requested that the case be closed. For the Public Ministry, although the facts are “ethically reprehensible” and correspond to a way of selling political influence, “it is not enough for the penal configuration.”
