João Alberto’s widow, Milena Borges Alves, rejected R $ 1 million in a proposal according to Carrefour. Now, his lawyers must go to court and collect between R $ 10 million and R $ 15 million. Of the total amount, half would correspond to compensation for moral damage and the other part for material damage. The widow’s lawyers end negotiations with the multinational on March 24.

João Alberto, 40, died after being beaten by two security guards in the Carrefour parking lot, in the north of Porto Alegre. The crime took place on November 19. Six people became charged with triple qualified murder, with two security guards arrested on the day of the crime.

Until then, the negotiations were confidential and it was necessary to sign a confidentiality term by Milena and her lawyers. OR Twitter he sought out Carrefour, who has yet to respond.

One of the reasons for the refusal is that the amount offered by the supermarket chain is the same that it paid for the death of the dog Manchinha, after being beaten by a security guard, also in Carrefour de Osasco (SP). The case happened in 2018. The French brand signed a commitment period and allocated R $ 1 million to organs linked to the animal cause.

In an open letter, the three lawyers for the widow criticized the amount offered to Milena. “We cannot stop comparing Manchinha with Nego Beto. It seems crude to make this comparison, but it is impossible not to make a parallel, since it seems that, for Carrefour, the value that is given to the life of a dog and a human being is exactly the same “.

For him Twitter, Attorney Hamilton recalled the case of George Floyd, murdered by a police officer in May last year in the United States. The compensation paid to the family was US $ 27 million, at the time of the decision equivalent to R $ 150 million. “It is very unfair. They literally ended Milena’s life. As soon as she leaves the house, she no longer works, sleeps two to three hours a day and is afraid of being attacked when she goes out,” says Ribeiro. Twitter.

“The comparison is inevitable (between the João Alberto and George Floyd case. That is, we need to change the jurisprudence, but we also need to change the culture, based on this negotiation! Two more questions remain for Brazilian society. What is life like? of a black Afro-Brazilian and a black Afro-American? When will dog-dog syndrome end? “Milena’s attorneys say in the letter.

Carrefour, according to the defender, would be “holding on” to a value stipulated by the STJ (Supreme Court of Justice) of 500 minimum wages. “In the Brazilian legislation there is no limit”, guarantees Ribeiro.

On the other hand, Carrefour reached an agreement in relation to Milena’s daughter and João Alberto’s stepdaughter. João Alberto’s father, Pastor João Batista Rodrigues, 65, also closed negotiations with the supermarket chain, which was confirmed by lawyer Rafael Peter Fernandes. In both cases, the values were not disclosed due to the confidentiality term.
