BRASILIA – Amid the climate of unrest in the Federal Supreme Court (STF) caused by the appointment of Kassio Marques to replace Celso de Mello, who retires on the 13th, Minister Dias Toffoli said that he and Gilmar Mendes were surprised with the judge’s choice for the vacancy last week. Last Tuesday, Toffoli was at a dinner at the home of Gilmar Mendes, which was attended by Marques and President Jair Bolsonaro, who, on the occasion, introduced his chosen one to the two ministers.

Yesterday, in a new social event, Toffoli received the president of the Senate, Davi Alcolumbre (DEM-AP), Marques and other guests at his house for lunch. A chef was hired to prepare seafood spaghetti. Crab cones were served at the entrance. Later, Toffoli called Bolsonaro to invite him to participate in the event. They watched a football game on television together and ordered loads of pizza in the evening.
– I am a boy who likes to bring people together, that everyone have fun. Fraternize. It was a fraternization, nobody was talking about work. We were not here to discuss a serious matter, ”Toffoli told GLOBO the Saturday after the meeting.
Although the chef was previously hired, Toffoli said Sunday that yesterday’s meeting was not pre-planned:
– Davi was here (at home) and I called the president to watch the game with us. People were arriving at the last minute.
Upon Bolsonaro’s arrival, Toffoli and the president gave each other a friendly hug. The image of the meeting was criticized by the president’s allies on social networks. The comments upset the Bolsonaro family, who publicly responded to some of them.
Before assuming office at the STF, Kassio Marques must appear before the Senate Constitution and Justice Commission (CCJ). Then, it must be approved by voting in the CCJ and in the plenary session of the Chamber. Toffoli said that in the two meetings he had with Marques, no strategy for these phases was discussed.
The minister also denied that the fate has been discussed in the investigation investigating President Jair Bolsonaro in the Supreme Court in the meetings. The case is under the report of Celso de Mello. The natural way would be for Marques to inherit the rapporteur of the process. However, between the retirement of the dean and the inauguration of the new minister, Fux may determine the drawing of a new rapporteur for the case, among the current ministers of the STF.
