According to a report from Intercept, Deltan Dallagnol gave up 20 of the 60 days of annual leave to return to work earlier than necessary and pocketed almost R $ 30,000 extra. Paid for with public money. Selling a vacation is not illegal. But the law prevents private sector employees from exchanging more than 10 of their 30 annual days off for cash.

By Vinicius Konchinski, at Intercept Brasil – The Republic’s lawyer, Deltan Dallagnol, published an emotional video on social networks to announce last September that he was abandoning the Lava Jato operation. At that time, the coordinator of the operation in Paraná, explained that he would leave his position to take care of his daughter, who, according to him, began to show signs of setback in development.

“She stopped saying some words that she was already saying, stopped looking at people when they called her and stopped looking at our faces and eyes,” she described.

Concerned, as any parent would be, Deltan said it was time to change focus. “After years of intense dedication to Lava Jato, I think now is the time to dedicate myself in a special way to my family. Those extra hours that I invested [na operação] In the evenings, weekends and holidays, now I will have to focus on my family. “

At the time, there were not a few analysts who saw in this justification a way found by the prosecutor to leave through the main door of Lava Jato after the numerous suspicions raised against the operation by the reports of the Vaza Jato series, published by Intercept and partner vehicles. The fact is that, three months after exposing his personal and family drama, Deltan seems to have changed his mind.

You gave up 20 of the 60 days of annual leave to which you are entitled to return to work sooner than necessary. Not for free, of course. With that, he pocketed almost R $ 30 thousand extra. Paid for with public money.

The money was credited to the attorney’s November paycheck. Only in that month, Deltan received more than R $ 42 thousand net, referring to the monthly salary and the third of vacations to which formal workers are entitled. To this is added the pile of bonuses and aid paid to members of the Federal Public Ministry and the vacation period sold. In total, they were more than R $ 76 thousand, net, in a single month.

Selling the vacation is not illegal. Any worker who has been in a hurry has. But the law prevents private sector employees from exchanging more than 10 of their 30 annual days off for cash. Deltan does not have the profile of the needy: his usual salary is R $ 33 thousand, almost the maximum that an official can receive in Brazil.

In November, when he sold the vacations, the prosecutor received almost double the so-called constitutional ceiling. Today it is almost R $ 39.3 thousand. It turns out that the aid does not go into this account, nor the economic subsidy – formal name of the amount received for the sale of vacations.

Prosecutors are some of the privileged few in Brazil with 60 days of vacation a year; judges and state prosecutors are also in the group. It is twice the vacation of those who work in the private sector, and look that we are not even talking about informal workers, most of them in Brazil, who stop working without money.

The double vacation, by the way, was put in the balance by Deltan when it considered a candidacy to the Senate in 2018. “It is a turbulence in family life, you earn less, you have less vacation, you are taking stones out of the window in a game of menitras, a great risk when disconnecting from the MPF, ”he wrote on Telegram in March 2017 – the original spelling was kept. I was responding to a campaign volunteer for ten anti-corruption measures because I did not want to leave the position of prosecutor and venture into electoral politics. The message is part of Vaza Jato’s file.

‘Inhuman’ work

In late 2019, prosecutors’ 60-day vacation became a topic of debate. A proposal to reform the Constitution that was being processed in the National Congress wanted to reduce them by half, equating the members of the MPF to the humble mortals with those of the majority who worked for the private sector.

At that time, the Attorney General of the Republic, Augusto Aras, rebelled against the attempt to end the privilege. In a note released in November 2019, Aras said that the workload for prosecutors was “to some extent inhumane” and therefore the 60-day vacation was justified.

Aras, however, showed some concern about the weight that the rights of the members of the MPF exercise on the public coffers when he ordered in a decree that all agency workers exhaust their time banks and take the pending holidays of 2018 and 2019 nothing but the pandemic. it forced them to prioritize remote work. This, according to the Aras ordinance, should occur by the end of July 2020.

The holidays partially sold by Deltan were from 2018. The prosecution agreed to sell part of them in September 2020. But it was only in November that an ordinance published by the PGR in November regulated the delay in compliance with Aras’s order .

“Deltan Dallagnol and the rest of the working group attorneys, on several occasions throughout the operation, worked during the formally taken vacation. The financial allocation refers to the sale of 20 vacation days, referring to part of the accumulated vacations, a right derived from the legal (Complementary Law 75/93) and institutional norms applicable to all members of the Federal Public Ministry, “said the MPF advisor. He simply did not comment that 60 days of vacation are a privilege of few in Brazil .

Thus, with half of the holidays in his pocket and apparently unaware of the advance of the pandemic in Paraná and Santa Catarina – aggravated by the criminal inaction of Jair Bolsonaro, whom Lava Jato helped to elect and govern – Deltan found time to even dedicate himself thereto. an activity he loves: surfing. Last weekend, he posted a photo with friends at the beach. It is the “surf team”, explained in the caption.

None of them wore a mask.
