President Jair Bolsonaro chose the judge to assume the vacancy left by Minister Celso de Mello. Marques is 48 years old and currently serves from the Federal Regional Court of the 1st Region, which is based in Brasilia.

The report was delivered to the Senate Constitution and Justice Commission (CCJ), in charge of investigating the magistrate.
Braga praised the academic training of the judge and highlighted the “balance between theoretical reflection and forensic praxis” of Kassio Marques.
“Without academic intentions, he deepened his studies in order to increase his own jurisdictional performance. And it was successful. Proof of this is the amount of well-founded decisions with high economic and social impact that he made in the nine years he was in the Federal Regional Court of the 1st Region, ”Braga said in the report.
In another excerpt, Braga criticized the issues raised about Marques’ resume, saying the judge is an example of “determination and perseverance.”
“He despises the example of determination and perseverance that Piauí Kassio Nunes Marques represents, who clings to the footnotes and between the lines of his bibliographic production to impose criticisms devoid of content,” wrote the rapporteur.
For Braga, the STF candidate does not need academic degrees to judge according to the Constitution and the laws.
“The nominee presented succinctly written arguments in which he demonstrates having professional experience, adequate technical training and intellectual and moral affinity for the exercise of the role of Minister of the Federal Supreme Court,” the report says.
“The courses he attended – carried out without prejudice to his jurisdictional functions, it should be noted – are additions of knowledge sought by a restless judge, not the frantic search to meet the requirements for the exercise of judicial power,” said Braga.
Braga stated that he did not observe “relevant facts that could raise doubts about his legal knowledge or damage his reputation, these, yes, constitutional requirements for the exercise of the position of Minister of the Federal Supreme Court.”
The judge’s hearing in the CCJ Senate is scheduled for October 21. The committee meeting is scheduled for 8 am. The vote in plenary is expected to take place on the same day.
To assume the position of minister, Nunes Marques must first be approved by the CCJ. Then, his name will be put to a vote in the main plenary session of the Senate, where he will need the support of the absolute majority (half plus one) of the senators.
