In a restricted ceremony, Luiz Fux takes office this Thursday as president of the STF | Politics

Born in Rio de Janeiro and with a law degree from the Rio State University (UERJ), Fux will replace Minister Dias Toffoli at the head of the country’s highest court. The mandate is two years.

This Wednesday (9), Toffoli commanded the last session as president of the STF. Court ministers, President Jair Bolsonaro and other officials paid tribute to the minister.

With the possession of this farm, Toffoli joins the First Class, from which Fux said goodbye last Tuesday (8). The class is made up of the ministers Rosa Weber, Marco Aurélio Mello, Luís Roberto Barroso and Alexandre de Moraes.

Earlier this month, Fux stated in a videoconference that one of the axes of his management before the STF will be the protection of the environment. Another axis must be the fight against corruption.

Fux has also said that there is a “search for a judicial role” and that many issues that come to the analysis of the Justice could be resolved by other spheres of power.

Still in May, amid criticism from members of the Jair Bolsonaro government of the STF, Luiz Fux defended the independent performance of judges as one of the main pillars of contemporary democracies.

In a letter in defense of the judiciary and democracy, he affirmed that independent action is carried out by those magistrates “who do not exempt themselves from applying the Constitution and laws to anyone, aiming at justice as a mission guided by impartiality and prudence”. .

The minister has also insisted on defending that the Court has not released the federal government from responsibility for the new coronavirus pandemic, as President Jair Bolsonaro has said. “The Supreme Court did not exonerate the federal executive of his functions,” emphasizes Fux.

One of the most influential decisions was made in November 2018, when Fux revoked the housing subsidy for judges, members of the Public Ministry, Public Defenders and courts of accounts.

The ceremony is scheduled for 4:00 p.m., in the palace where the STF headquarters is located. The formal session will be restricted due to the new coronavirus pandemic.

Only the authorities and relatives closest to the minister will be present. The use of a mask will be mandatory and the temperature of the gifts must be measured.

Clear acrylics will be temporarily installed on the minister’s bench and honor table to create individual spaces. The alcohol gel will also be available in all positions.

The presence of authorities such as President Jair Bolsonaro is expected; the presidents of the Senate, Davi Alcolumbre, and the Chamber of Deputies, Rodrigo Maia; the Attorney General of the Republic, Augusto Aras; the president of the Federal Council of the OAB, Felipe Santa Cruz; and the STF ministers.

Born in Rio de Janeiro in 1953, Luiz Fux turned 67 in April of this year.

Graduated in Law from the State University of Rio de Janeiro (UERJ) in 1976, he practiced law for two years, was a prosecutor for three more years, until he entered the magistracy in 1983, as a state judge.

In 2011, he was appointed Minister of the Supreme Court by the then president Dilma Rousseff, in the vacancy resulting from the retirement of Minister Eros Grau. He took office in March of that year. Since then, his office has issued around 77,000 orders and decisions, 52,000 of which are final, 57% less than when he entered the Court.

Before joining the STF, Fux spent 10 years in the Superior Court of Justice (STJ), where he stood out for his specialization in the civil area, the minister is a free professor in the area and coordinated the working group of Congress that formulated the new Code of conduct. Civil Procedure, sanctioned in 2015.

In the electoral sphere, Fux stood out in the Supreme Court as a defender of the strict application of the Clean Registry Law, a law passed in 2010 that prevents the candidacy of politicians convicted of crimes by collegiate courts.

In 2018, he assumed the presidency of the Superior Electoral Court, replacing Minister Gilmar Mendes.
