The federal government begins depositing payments this month for formal workers who adhere to the agreements for suspension of contracts or reduction of hours and wages. According to the Special Secretariat for Social Security and Labor, linked to the Ministry of Economy, the first benefits would be deposited on Friday (1).

The agreements began to be signed on April 1, the date of publication of Provisional Measure No. 936 by President Jair Bolsonaro, who specifically authorized these labor regulations to face the economic crisis caused by the covid-19 pandemic.

The federal government’s expectation was that up to 5 million workers would be in these deals on Thursday night (30). The total estimated cost of the program is R $ 51 billion.

The MP establishes that the payment is made 30 days after the agreement, if it has been communicated to the Ministry of Economy within 10 days after the closing between the boss and the employee. Otherwise, the benefit will only be paid to the worker 30 days after the date of the information.

In order for the worker to receive the benefit, the checking or savings account must be in his name, not that of a third party. The Ministry of Economy planned to open digital accounts for workers who do not have an account.

According to the MP, reductions in wages and hours are valid for up to 90 days and can be 25%, 50%, and 70%. The government pays the same percentage of the cut (25%, 50% or 70%) calculated on the amount of unemployment insurance to which the worker would be entitled if he were fired. It is not a matter of anticipation, that is, if the worker is dismissed from the company without any cause, he will normally be entitled to unemployment insurance.

After the contract is suspended, for up to 60 days, the government pays 70% of the insurance, in the case of employees of large companies, or 100%, in the case of workers in small and medium-sized companies.

The provisional measure was immediately questioned in court by the Rede Sustentabilidade party, which indicated in the STF (Federal Supreme Court) the alleged unconstitutionality of the possibility of reducing wages without a collective agreement with the participation of a union.

The party obtained a favorable mandate from Minister Ricardo Lewandowski. Judging the issuehowever, the ministers maintained for 7×3 the possibility that the agreements between bosses and employees be signed without the need for the union’s intermediation.
