Globo presses São Paulo and teams to veto Atlético broadcast

Globo is putting pressure on Serie A clubs to prevent the broadcast of Atlético de Brasileiro matches on their own platforms, as evidenced by the documents obtained by the blog. One of the station’s targets was São Paulo, which faces the Paraná team this Sunday in Curitiba. Athletico has a favorable judicial decision to broadcast its matches on its channels in dispute with Globo.

The fight between the club and the announcer comes from the signing of the Brazilian contracts. All the clubs signed agreements for the Open TV and pay-per-view platforms, while the Paraná club only crossed paths with the Open platform.

In 2020, Athletico used the MP Principal, while it was in force, to sell its ppv rights to the company “Live Move”. From there, he created a platform on Twitch to stream paid games. But Globo questions this right in court. So far, a decision of the Court of Justice of Paraná has proved the club right.

Atlético then broadcast the match against Vasco, including a package for visiting fans. And he will do the same in the game against São Paulo, which will have an open broadcast.

From then on, Globo began sending notifications to clubs reminding them of the exclusive ppv contract they have with the station. And he asked the associations to take measures to prevent transmission. So far, clubs like Sport, Ceará, Flamengo and São Paulo have received the notifications.

In the process between the parties, there is Globo’s letter to the clubs. In the document, they claim breach of the exclusivity of PPV for the broadcast of the club. This, according to the station, generates “serious contractual consequences.”

Globo will continue to take all measures to curb the illegal conduct of CAP, but, based on the long association maintained with all the clubs competing in the competition and in particular with V. Sas., Believes that the clubs, and in particular the CLUB, will not agree with this evident violation of the exclusive rights granted to GLOBO; the document says. Then he asks the clubs to notify Atlético.

Faced with this letter, the Paraná club filed a petition in the lawsuit in the Paraná court: it alleges “procedural bad faith” and that the station makes it difficult to comply with a judicial decision.

“As Globo loses in the Judiciary – there are already 5 unfavorable decisions for the station here in TJPR -, it ignores the authority of the jurisdiction, inciting third parties to turn against the CAP. As established in article 77, IV, of the CPC, it is the duty of the party and its lawyers “to faithfully comply with the jurisdictional decisions, provisional or definitive, and not hinder their effectiveness. And he concluded by saying that it is “an act that violates the dignity of Justice.”

It is not the first time that Globo has resorted to clubs to press lawsuits. In the legal dispute with Turner, he asked the associations he had a contract with to speak on his behalf in the process. At that time, 11 clubs sent letters of support to the station to the courts.

Asked about the Atlético case, Globo denied the pressure on the clubs and said that it would not comment on the cases in court: “Globo does not comment on sub judice matters, but it can clarify that it always respects and accepts judicial decisions, even if it does not agree. with them”. without prejudice to the adoption of the resources provided by law. There was no pressure on the clubs. Only the discussion of a common problem of the commercial partners: the violation by a third party of the exclusivity contracted between the announcer and the clubs ”.
