Minister Celso de Mello was honored today by his colleagues in his last session in the Second Panel of the STF (Supreme Federal Court).
Celso is retiring next Tuesday (13) and this is his last week of sessions in the Supreme Court.
Minister Gilmar Mendes, president of the Second Panel, delivered a speech in which he praised the minister’s career and, at different times, showed his emotion.
“His exquisite performance as a constitutional judge marks the impeccable legacy of a guarantor who never refused to seek innovative solutions within the constitutional system for the protection of rights,” said Gilmar.
Celso de Mello is the Dean of the STF, the minister with the longest service. He took office in 1989 and is leaving court to turn 75, the age at which retirement is required by law. The minister celebrates his birthday on November 1.
“However, any attempt to record the meaning of the Dean’s career would be unable to grasp the symbolism of his figure for the members of the Court,” said colleague Gilmar Mendes.
“Celso’s presence in the Federal Supreme Court does not end at this warm moment, it will be constantly projected by all those who believe in the relevance of constitutional jurisdiction for the construction of a democratic and just society,” said the minister.
In addition to Celso and Gilmar, the Second Panel is also made up of ministers Ricardo Lewandowski, Cármen Lúcia, and Edson Fachin.
“Memorable votes will be recorded in the memory of this court, such as those that dealt with the principle of secularism and human dignity, or even as an example, in the case of stem cell research, and those that contributed to remove the authoritarian rubble of our legislation, in particular the Press Law trial, ”Fachin said.
“The outstanding contribution of the eminent minister Celso de Mello, as judge of this Supreme Court, is reflected not only in the votes cast, but also in the truly humane character of his performance,” said the minister.
Celso de Mello thanked his colleagues for their tributes and also showed emotion in his speech.
“The Supreme Federal Court, much more than the highest organ of the National Judicial Power, charged with defending the Constitution and fundamental freedoms, represents for me a true state of mind,” said the minister.
“And more than that, a state of mind that induces the longing that I will keep forever from the days I was in this high judicial court of our country,” said Celso.
Investigation against Bolsonaro
The minister must also participate in the plenary sessions of the STF this Wednesday (7) and Thursday (8), a collegiate that brings together the 11 members of the tribunal.
On Thursday the trial is scheduled to find out if President Jair Bolsonaro (without a party) will be able to give written testimony or should be heard in person in the investigation of the alleged attempt of undue interference by the Federal Police. The president denies the practice of irregularities.
Celso de Mello is the reporter of the investigation and maintains that the President of the Republic must testify in person when he appears as investigated in a trial.

For the vacancy that will open in the STF with the retirement, Bolsonaro told Judge Kassio Nunes Marques, 48 years old. His name has not yet been approved by the Senate. Marques will be heard in audience by the senators on the 21st.
Currently a federal judge in the TRF-1 (Federal Regional Court of the 1st Region), Nunes began his legal career in law.
As a lawyer, he was appointed in 2008 for a judge vacancy at TRE-PI (Regional Electoral Court of Piauí).
In 2011, he assumed the position of federal judge of the TRF-1, appointed by the then president Dilma Rousseff (PT), after being appointed to the position in a six-fold list prepared by the Brazilian Bar Association (OAB).
