After 24 years since the death of Gabriela Chermont, in Vitória, the trial of the girl’s ex-boyfriend, Luiz Claudio Ferreira Sardenberg, came to an end on Thursday (12). He was convicted of murder to 23 years and 3 months in prison. Luiz Claudio has already been detained from the Vitória Penal Forum, around 10 pm this Thursday, after three days of trial.

Gabriela died after falling from the twelfth floor of a hotel in Vitória, on the morning of September 21, 1996. The popular jury, which had been postponed 9 times, lasted three days. Seven members of the jury, four women and three men, participated in the popular jury and defined the fate of the accused.

The prosecution’s thesis, prepared by the Public Ministry with the prosecutor’s office hired by the victim’s family, maintained the impossibility of suicide, since Gabriela never faced depression, having been happy and full of friends.

Furthermore, the defendant’s indictment noted the defendant’s use of drugs such as cocaine, in addition to the use of alcohol, which may have contributed to the defendant’s violent action.

The defense, supported by the lawyer Raphael Câmara, pointed out the thesis of the suicide of the victim, who would have had a healthy four-year relationship with Luiz Cláudio.

In the jury’s opinion, Luiz Claudio Ferreira Sardenberg attacked and threw Gabriela Regattieri Chermont from the balcony on the 12th floor.

THREE DAYS OF THE JURY

The 12 witnesses in the case, including those summoned by the defense and the prosecution, were heard in the jury, which began on Tuesday (10) and ended on Thursday night (12). The prosecution says the statements reinforced the version that the young woman was murdered.

The defendant Luiz Cláudio Ferreira Sardenberg was listened to throughout the morning of today (12) until around 1:40 pm, to answer questions from his defense lawyers, the prosecution, the Public Ministry and the magistrate who presides over the jury.

Then seven members of the jury voted to define the defendant’s sentence. The vote is secret. Even before the judge handed down a sentence, Gabriela’s family lawyer Cristiano Medina asked Luiz Cláudio to get out of jail.

Gabriela was 19 years old when she died, after falling from the twelfth floor of Apart Hotel La Residence, a hotel in Mata da Praia, in Vitória, at dawn on September 21, 1996. The young woman’s ex-boyfriend, Luiz Cláudio Ferreira Sardenberg , was soon charged with the crime of murder. The businessman’s defense, however, alleged that the victim committed suicide.

Witnesses in the file report that the ex-partner went to a bar in Jardim da Penha and who then he went to the Apart Hotel, where they stayed in apartment number 1,204.

Luiz Claudio, from then on, affirms that the two had sexual relations, while the defense of the victim’s family alleges that they did not and that, instead, there were several attacks, even causing broken teeth and abrasions on the Gabriela’s lumbar area, finally triggering the dragging and projection of the victim across the balcony.

A toxicological examination carried out at that time identified that the dealer had consumed cocaine, contrary to his claim, in the sense that he only drank beer.
