In the petition, the Deputy Attorney General of the Republic, Humberto Jacques de Medeiros, affirms that there is “an effective risk that the patient in freedom may create public order.”
André do Rap is one of the chiefs of the First Capital Command (PCC), a criminal faction that works inside and outside São Paulo prisons, he was released from the Presidente Venceslau Penitentiary, in the interior of São Paulo, this Saturday for the tomorrow (10).
He had a habeas corpus granted by Minister Marco Aurélio Mello, released on Friday afternoon (9).
Fux affirms in the decision that the release “compromises public order and security”, as he is a patient “of proven very high risk” and with “double second-degree sentence for transnational drug trafficking.”
The minister also says that the suspect has “high-level participation in a criminal organization, with a fugitive history for more than 5 years.”
André do Rap was arrested in September 2019, in an operation carried out by the São Paulo Civil Police in a luxury condominium in Angra dos Reis, on the coast of Rio de Janeiro, and is being investigated for having a leadership role within the PCC and managing sending large shipments of cocaine to Europe.
André do Rap, who was released from jail this Saturday, said he lives in Guarujá, where he can be found.
In a note, the Secretary of Penitentiary Administration (SAP) confirmed “that he complied today, 10, with the release permit for the prisoner André Oliveira Macedo, by judicial decision of the Federal Supreme Court. He left the Penitentiary II of President Venceslau at 11 : 50 am. Tomorrow. ”
