Former doctor Roger Abdelmassih, sentenced to 173 years in prison for sexual abuse of patients, is returned to São Paulo prison on Monday (31). He had been released in April to serve a prison sentence for belonging to the group at risk for the new coronavirus.
A determination was issued by the Sixth Criminal Chamber of TJ-SP (São Paulo Court of Justice) after appeal by the MP-SP (São Paulo Public Ministry).
Abdelmassih is 76 years old and suffers from a chronic illness. Before his release, he was serving a closed sentence.
Following the adoption of the new regime, the former doctor was also released from the use of electronic anklets due to lack of equipment in the prison system. In a domiciliary regime, you cannot leave the house, except in a medical emergency.
The request for house arrest was made at the end of March, after the court authorized the release of some prisoners from the semi-open regime. Abdelmassih’s defense claimed that he was subject to the risk of death if he was infected. In addition to old age, he has severe heart disease.
The Public Ministry affirmed that all the conditions exist for Abdelmassih to serve his sentence in the penitentiary. According to the Public Ministry, the recommendation of the National Council of Justice, on the protocol for the prison population in the new coronavirus pandemic, cannot justify the unbridled release of the prisoners.
