This Thursday 3, in a ruling by the State Justice, the Folha de São Paulo newspaper and the journalist Patrícia Campos Mello were ordered to pay R $ 100,000 to the brusque businessman Luciano Hang, owner of the Havan chain of stores. The moral damage lawsuit refers to an article published by Folha in 2018. The report points to Hang as one of the businessmen who bought a package to shoot anti-PT messages on the networks, which is an electoral crime.
According to the ruling, the Folha investigation simulated the search for an agency carrying out the mass shooting. It would be sending messages against the PT. However, it was reported that in the week leading up to the second round they already had a considerable request.
It would be from a company that was campaigning for then-candidate Jair Bolsonaro. On this occasion, Havan’s name would have appeared among the companies that had hired such shots.

However, after further investigation, “they used the argument of the constitutional guarantee to inform, maintaining the confidentiality of the source, and that full proof of the contracting of the shots fired by HAVAN cannot be required.”

The document is signed by judge Gilberto Gomes de Oliveira Junior. The sentence was published by the Court of Justice of the State of Santa Catarina Vara Cível da Comarca de Brusque.
“Although the press does not need, in the investigation and dissemination of news, the same degrees of solidity and certainty that a judicial process requires, as raised by the defendants in their defense, obviously this fact does not authorize the press to publish news that The applicants of such a scheme of mass shootings of messages in the middle of the electoral period are linked, without any factual basis, since, although those requested in the defense name the alleged sources of information, they did not present the content of these sources, not even anonymously, which managed to link the applicants to the news dissemination scheme during the electoral period, in accordance with the electoral illegal contained in the respective current law, ”he says.
“The damages resulting from the report are clear, since the media repercussion around these events was manifest, reaching the point of affecting the participation of the first applicant in an Electoral Judicial Investigation Action before the TSE, indicated in the file”, complete another part of the sentence.
The initial compensation claim had been R $ 2 million. However, after the process, it was decided that the amount would be R $ 100 thousand. The judge considered it “adequate to compensate for the shock suffered.” It is possible to appeal.
