RIO and SÃO PAULO – At least ten militant militants, several of them members of movements created after the election of the president Jair Bolsonaro, have participated in the articulation of acts with undemocratic agendas in Brasilia since April. The protesters carried out attacks against the Congress and the Federal Supreme Court (STF), in caravans and camps on the Esplanada dos Ministérios, and were also associated with attacks on journalists and health professionals in early May. The demonstrations had the support of parliamentarians who form the base of the government in the Chamber. In addition to participating in the events, at least seven allies of the president also publicized the movement on social media.
Bolsonaro’s supporters have expressed their intention to watch on the Esplanade demanding the resignation of the mayor, Rodrigo Maia (DEM-RJ) and the ministers of the Federal Supreme Court (STF). The action was launched by the National Organization of the Movement (ONM), created in the middle of last year. One of those responsible for calling the so-called “Patriot Camp” was Renan da Silva Sena.
Sena worked as an external employee of the Ministry of Women and Human Rights until last Monday, when he was discharged. In late April, he recorded promotional videos of the camp with businesswoman Marluce Carvalho, from Palmas (TO). Sena and Marluce were mentioned in police reports as attackers of a group of nurses who demonstrated on Labor Day near the Bolsonar militants’ concentration place.
Another group that even installed tents in the Esplanada was the “300 for Brazil”, created in April by activist Sara Winter. She became coordinator of Comprehensive Care for Pregnant Women in the portfolio of Women, Family and Human Rights, by Damares Alves.
One of the members of the field led by Winter, the Bahian microentrepreneur Sidney Espinheira, was photographed by Dida Sampaio, of the newspaper “O Estado de S. Paulo”, shouting in the direction of the professional moments before being shot down and attacked, on the spot last Sunday. Espinheira denied the assault. Winter claimed on video that his colleague was being maligned for his militancy in favor of Bolsonaro.
STF Research
On the 20th, the STF authorized the opening of an investigation by the Office of the Attorney General of the Republic (PGR) to investigate the organization of the protests in Brasilia, due to undemocratic banners. The opening of the investigation, although it did not mention the president, was authorized by the Court after Bolsonaro participated in a demonstration for the closing of Congress, in front of the army headquarters in the federal capital, on the 19th. Given the PGR, it acts with the same undemocratic flags organized in the following weeks received the support of Bolsonaro’s allies, including the Minister of Citizenship, Onyx Lorenzoni. Last Sunday, Onyx circulated among the protesters. The day before, he recorded videos with the organizers of “300 do Brasil”. Wanted by BALLOON, Onyx did not return contact.
The investigation points out, in addition to leaders of the street movements, to Bolsonarista deputies who participated in the acts, such as Cabo Junio Amaral (PSL-MG) and Daniel Silveira (PSL-RJ). Without a mask, which also did not meet the recommendations for social isolation, Silveira circulated among the protesters and posed with a banner with the inscription “Foros, Maia!”
Amaral, another who circulates without a mask in the demonstrations, said the events have “different agendas” and that no deputy has joined anti-democratic flags.
– I did not see any Bolsonar deputy talking about AI-5, military intervention or use of weapons. That would characterize the crime. The demonstrations show, from what I understand, dissatisfaction with judicial activism and with old practices in the House, such as the appointment of positions to vote for what the Executive proposes, he evaluated.
However, supporting undemocratic protests can result in a crime charge against national security, according to Eloísa Machado, a professor of constitutional law at FGV in São Paulo. According to her, the deputies and protesters in this situation can be framed, mainly, in articles 16, on the integration of groups whose objective is to change the current regime by violent or threatening means, and 18, which refers to the attempt to avoid the free exercise. of any of the Powers of the Union.
Machado, however, makes reservations about the constitutionality of the law, which was created during the military dictatorship.
– The National Security Law brings open types that can criminalize any criticism of the Powers, which is not accepted by the Constitution. It is a typical authoritarian rubble of the dictatorship, and it remains ironic that it is used against people who precisely preach the return of the dictatorship, she says.
For USP professor Daniel Falcão, a specialist in Constitutional Law, the protests can also be classified as a crime against national security. According to Falcão, to say that “the Congress and the Supreme Court” hinder the Bolsonaro government is to be undemocratic.
– There is no disturbance, there is a Power that controls the other. Then the Judiciary, if provoked, can decide saying that the acts of the Executive are against the Law, and the Legislative can also revoke the acts of the Executive if it understands that they are unconstitutional. And the Executive also controls this. The president can veto bills from Congress. This is democracy, says the professor.
Retired military personnel
Among the organizers of the events in Brasilia there are also militants who identify themselves as graduates of the Armed Forces, such as Paulo Felipe, leader of the “Soldiers of Brazil” movement, which openly defends military intervention in the country. Navy Reserve Captain Winston Lima, known for having a YouTube channel that records Bolsonaro’s daily interactions at the door of the Palácio da Alvorada, has also been articulating weekly caravans since April and spoke in one of the cars of sound in the last act. Sunday
The organization of undemocratic acts also included enthusiasts for the creation of the Alliance for Brazil party, such as the Minas Gerais psychologist Wagner Cunha. Leader of the Conservative Right Movement, launched in late 2019, Cunha defends the use of the Armed Forces to eliminate ministers from the Supreme Court. Last Sunday, his speech was accompanied in one of the sound cars by Cibelle Rodovalho, cousin of Bishop Robson Rodovalho, leader of the evangelical denomination Sara Nossa Terra. Another supporter of Aliança in undemocratic acts was Marcelo Stachin, who even collected party files in a camp on the Esplanada dos Ministérios.
Affiliated with PSL in Sinop, Mato Grosso, Stachin was one of the participants at the end of last year of the Conference on Conservative Political Action (CPAC) in Brasilia, an event organized by Congressman Eduardo Bolsonaro (PSL-SP) at the facilities of the Congress. Eduardo participated in the acts last Sunday on the ramp of the Planalto Palace, along with his father, President Jair Bolsonaro, and other deputies, such as Hélio Lopes (PSL-RJ), Bia Kicis (PSL-DF) and Caroline de Toni (PSL-SC).
