Federal Justice releases the resumption of trade, but intensifies activities in the DF

The chief judge of the 3rd Federal Civil Court of the Federal District, Kátia Balbino de Carvalho Ferreira, granted, in part, the mandate on the expansion of the operation of non-essential activities in the Federal District, due to the new coronavirus. In his decision, the magistrate scheduled the return of the trade, with an interval of 15 days.

With this, wholesalers, commercial representatives and retailers will be able to open the doors, in accordance with the planning of the Federal District Government. The decision also includes the resumption of services, information and communication activities, such as advertising agencies, business consultancies, as well as travel agencies, supply and management of human resources, and associative activities. However, schools, public administration, cinemas, cultural activities, academies, clubs and religious temples are in the last block, that is, they can only return after 45 days from the granting of the court order.

In the so-called intermediate block, there are shopping malls and shopping centers, which can open after 15 days of the decision. The restaurant, food and beverage service sectors enter Block 3 (after 30 days).

The magistrate emphasized that it is necessary to establish sanitary protocols in each of the specific economic activities, as was done for banking activities, specifying, among others, the number of people per square meter to avoid crowds and allow the minimum distance recommended by the authorities of Health.

In the first 15 days:

  • Wholesalers, sales representatives and retailers: information and communication activities (such as advertising agencies and business consultants)
  • Administrative activities and complementary services (such as travel agency, supply and management of human resources for third parties)

Intermediate block

After 15 days:

After 30 days:

  • Restaurants and other food and beverage service establishments.

The judge also mentions that it is necessary to guarantee the supply of personal protective equipment to all employees, collaborators, subcontracted workers and service providers; 70% alcohol gel for workers and consumers; specific rules for cleaning the environment; temperature measurement and referral to the health network of people with symptoms; Specific rules that promote the isolation of the elderly, children, pregnant women, and people with chronic illnesses, such as absence from work, special or scheduled appointments, or turnaround times, and job rotation schedules.

The Court also details that it is necessary to have rules for the use of toilets and places to eat, operating at times that best satisfy the mobility of workers who use public transport, indicating the agencies responsible for the inspection. As for public transport, rules should also be established for the number of passengers to avoid overcrowding.

Still, as proposed by the Federal District, access to parts of the data related to the occupation of hospital beds and ICUs (intensive care units), the flow in the use of public transport, as well as other elements that they allow a transparent understanding of the measures that have been adopted by the Federal District in the fight against Covid-19, ”said the judge.
