A bill that is pending in the Chamber of Deputies proposes that the frequency of driving schools, both for theoretical and practical classes, it is no longer mandatory to do the National driver’s license (CNH).
Bill 4474/20, drafted by Deputy Kim Kataguiri (DEM-SP), aims to make the process of obtaining the CNH more accessible and less bureaucratic. “The project allows the instruction of future drivers to be carried out privately, without the need for the candidate to attend a driving school,” he said.
Currently, to take the CNH, the candidate must comply with the required hours of theoretical and practical classes at the Driver Training Center (CFC), better known as driving school. With the proposal, instruction can be conducted independently, thus making school attendance optional.
There is yet another proposal on the training of drivers under analysis in the Chamber. This is Law Project 3781/19, which also suggests that driving school becomes optional in the process of obtaining the CNH. Currently, more than 200 projects that modify the Brazilian Traffic Code (CTB) are in the legislative house.
What changes with the project?
After opening the process to take the CNH and take the psychological and physical and mental aptitude tests, the candidate must pass the theoretical driving school course, where they will learn about traffic legislation, defensive driving, basic mechanics, first aid, citizenship and environment. ambient.
With the proposal, transit agencies would have to make the materials freely available on site. In this way, the candidate will be able to study these contents on their own, without having to attend the course to prepare for the theoretical exam.
As for the driving test, practical classes are required in the vehicle on public roads. Part of the training can also be done in the simulator or at night, so that the candidate can practice driving in different conditions.
Today these trainings are offered exclusively by driving schools. With the bill, classes can be taught by an independent instructor, accredited by transit agencies, provided the following requirements are met:
- The independent instructor must have been qualified in the same category as the candidate for at least five years;
- Not having been sanctioned with the suspension or impeachment of the CNH in the last five years;
- Not have an ongoing lawsuit against you regarding these penalties;
- Not be convicted or respond to a traffic crime case.
The independent instructor who meets these conditions must use a duly identified vehicle for learning purposes, as established by the National Traffic Council (Contran).
