In a note released Tuesday, the senator’s defense confirmed the request for an investigation. The lawyers say they want to discover the “participants of the real gang that acted there [na Receita] for so long, violating, cowardly and clandestinely, innumerable rights of the parliamentarian, using invisible passwords and people who functioned as real ghosts in the execution of these crimes ”.

Until Tuesday night, the Attorney General’s team, Augusto Aras, continued to analyze the request.

Last Friday (23), the magazine “Época” revealed in a report that the defense of Flávio Bolsonaro mobilized organs of the government of Jair Bolsonaro to find alleged flaws in the behavior of the Federal Treasury in the case of the “crackers.” Despite the mobilization, the agencies found no such irregularities.

In the office of the then state deputy Flávio Bolsonaro, the scheme, according to the Public Ministry, was administered by Fabricio Queiroz.

The politician’s defense claims that, to produce reports, IRS officials had violated the senator’s rights. According to Flávio Bolsonaro’s lawyers, the tax officials collected information that supported intelligence documents from the former Coaf (Council for the Control of Financial Activities), currently called the Financial Intelligence Unit.

One of these documents revealed the scheme that, according to the Federal Public Ministry, would have the participation of Flávio Bolsonaro, son of the president: the embezzlement of public money in the Legislative Assembly of Rio de Janeiro (Alerj) through “crackers”, the practice of parliamentarians to recover part of the salary of employees.

The Sindicato de Auditores Tributarios (Sindifisco) stated in a note last week that the Federal Treasury does not transmit information to Coaf – the exact opposite is the case. Coaf is the body that produces financial intelligence reports, so-called RIFs, based on information provided by financial institutions that are required to inform the body of unusual financial transactions.

Try to stop counting

This was not the first attempt by Flávio Bolsonaro’s defense to quash or stop the investigation into the alleged “crackers” of Alerj.

In July last year, at the request of the senator’s defense, Minister Dias Toffoli, then president of the Federal Supreme Court, temporarily suspended all ongoing investigations in the country that were based on confidential data shared by Coaf and the Treasury without prior authorization from Justice.

But in November, the STF plenary held that it is legal for the IRS to share tax returns and bank statements with the Public Ministry. However, the court ruled that this must take place within official channels. With this decision, the investigation of the case of Flávio Bolsonaro could be resumed.

What public agencies say

The report of the magazine “Época” indicates that, in search of this investigation on Federal Income, Flávio’s lawyers called the Office of Institutional Security (GSI, linked to the Presidency of the Republic), the Brazilian Intelligence Agency ( Abin), Serpro – a state company that provides information technology services to the government – and the Treasury itself.

After the article was published, TV Globo sought the advice of the Palácio do Planalto, which stated that the body that should respond was the Office of Institutional Security.

The GSI confirmed that it had been contacted by Flávio Bolsonaro’s lawyers. He stated that the matter could appear to be institutional security because it involves a member of the president’s family.

But GSI said that the complaints presented by the lawyers turned out to be an internal matter of the Federal Treasury and that, respecting its legal powers, it did not take any action.

The Brazilian Intelligence Agency did not comment on the presence of its director at the meeting described by the magazine “Época” and sent the same note sent by the Office of Institutional Security.

The IRS declined to comment.

Serpro did not respond to the request for information.
