OR National Institute of Social Security (INSS) You can double your deadlines for granting social security benefits. The measure was authorized through Supreme Court of Justice (STF), which approved the court agreement.
The decision of Minister Alexandre de Moraes, rapporteur of the appeal, was published on December 10. Now, the INSS will be able to extend the term to analyze the processes of almost all types of pensions from 45 to 90 days. However, no disability benefit will be allowed, which remains with the original term.
How are the deadlines?
The benefit payable to low-income seniors and people with disabilities will also be subject to an adjustment in the term, from 45 to 90 days. In the case of death pension applications, the review period will be increased to 60 days. Now, the maternity pay will have a 30-day wait.
The agreement signed between government agencies and the Public Ministry of the Federation (MPF) received criticism from professionals and entities related to the social security law for not respecting the legal term (45 days) for the granting of benefits.
The INSS and the Attorney General’s Office, through a note, confirmed that the new deadlines would allow the government to end the waiting lines for benefits, which, in practice, can last much more than 90 days.
Waiting line
Currently, the waiting list for INSS benefits already exceeds 1.8 million applications. The number was passed through a survey conducted through the IBDP (Brazilian Institute of Social Security Law).
However, according to the text of the STF, the INSS will now only be obliged to comply with the new deadlines starting six months after approval. In other words, a process started today could be completed only at the end of the third quarter of 2021, that is, nine months after the application date.
The long term for the beginning of the application of the new terms can be justified in the agreement as a necessary period for the INSS to adapt to the new requirements and to be able to effectively grant the benefits without delay.
