CNH Free and without obligation of driving school; look what can change

A National driver’s license (CNH) free, can be issued by low-income people. The proposal is contained in the text of Draft Law (PL) No. 3,904 / 2019, written by Federal Deputy Emerson Miguel Petriv (PROS-PR).

Furthermore, the frequency in driving schools to get the National driver’s license (CNH) can become optional. The measurement appears in the Bill 4474/20, whose text is already under analysis in the Chamber of Deputies.

Learn about the two projects that can change the way CNH is obtained in Brazil:

CNH Social

The MP’s proposal aims for the card to be used for professional purposes. The idea is that the program reaches the entire national territory. Thus, the project clarifies that all the stages of issuing the document will be free, from the mandatory exams.

“For the poorest sectors of the population, National driver’s license – CNH It is another opportunity to get a job, to develop an economic activity. However, with the requirements created by the Traffic Code in force, the cost of classes, exams, driving vouchers and other administrative costs, has prevented this part of the population from accessing habilitation services, ”said the deputy.

According to the deputy, the purpose of the bill is to institute the CNH Social Program at the national level, aimed at low-income people, with the purpose of providing free access to driving services for driving motor vehicles.

Some states have already created the program such as:

Bay – In Bahia, there are two ways to obtain the first free license. The first is by the Detran School of Public Transportation – EPTRAN, which gives low-income people free access to the first driver’s license.

Amazon – In the State of Amazonas, an alliance was signed between the government and the Union of Driver Training Centers and registration can be done through the Amazonas application in Palma da Mão, in addition to the DETRAN website itself.

Pernambuco – The State of Pernambuco is one of the most frequent in the participation of the program, being in the ninth participation. People registered in the Bolsa Família, Chapéu de Palha, graduates of the prison system, socio-educational students of Funase, the unemployed (family income up to three minimum wages) and secondary and primary students of the state public system can participate.

Ceará – Ceará has participated in the program since 2009, being financed by the State Government, and covers categories A and B, for low-income people over 18 years of age.

Paraíba – In this State, people from the Prójovem or Literate Brazil programs and people who have graduated from the Penitentiary System or who have completed a socio-educational internment measure can participate. For categories A and B, in addition to the changes for categories C, D and E.

Thus, the parliamentarian proposed the creation of an Access Program to the CNH to be implemented by the Public Power for people registered in the Single Registry of Social Programs of the Federal Government or who prove to be economically needy and whose family income is up to three salaries minima. which are precisely those who are considered low income.

“I understand that the benefit should not be valid for renewals. The intention of the measure is to promote the candidate with more job opportunities and not be permanent. The benefit, however, maintains the obligation to carry out all the necessary and indispensable exams for the qualification in the foreseen category, which will be carried out by public entities or accredited entities ”, says the deputy.

It is worth mentioning that to have access to CNH Social it will be necessary for the interested party to meet some requirements, for example, more than 18 years for category “B” or more than 21 years (or two years of CNH with category “B”) have category “D”.

In addition, it is necessary to reside in the state of the process for at least two years; have a complete basic education level (knowing how to read and write); and family income of up to three times the minimum wage per person.

CNH without driving school

“The project allows the instruction of future drivers to be carried out privately, without the need for the candidate to attend a driving school,” explained the author of the project, Deputy Kim Kataguiri (DEM-SP). The intention, according to him, is that the process of obtaining the CNH is “less bureaucratic and expensive”.

According to the text of the proposal, to carry out written tests, covering knowledge of traffic legislation and first aid, traffic agencies must offer free material on their website, which allows self-instruction.

In the practical driving test, which is carried out on public roads, the instruction can be carried out by an independent instructor, accredited by the traffic agencies.

For this, the instructor must have the qualification in the category desired by the candidate for at least five years. In addition, you will need:

  • have not been sanctioned, in the last five years, with suspension or revocation of the right to drive, or
  • have ongoing proceedings against you for these sanctions; and
  • not be convicted or prosecuted for a traffic offense.

The vehicle used by the instructor must contain his own identification of the learning condition, in the form established by the National Traffic Council (Contran).

In addition to this proposal, another project makes driving school training optional for candidate drivers (PL 3781/19). The proposal is being processed in conjunction with more than 200 other projects that modify the Brazilian Traffic Code (CTB).
