The Corregedoria of the Chamber of Deputies notified this Wednesday (9) Mrs. Flordelis (PSD-RJ) about the process to which it responds for breach of parliamentary decorum and that may lead to the loss of her mandate.
The MP and her children are charged in a lawsuit investigating the murder of her husband, Pastor Anderson do Carmo. She is accused of being the mastermind of the crime.
Flordelis received the notification in his functional department, in Brasilia, from the magistrate, deputy Paulo Bengston (PTB-PA). He had to go there in person after the deputy failed to appear in the Chamber of Internal Affairs of the Chamber, as agreed.
In an interview after being notified, Flordelis denied any mismatch and said that he received the corregedor at his home because he is working, and that he will even participate in the plenary session on Wednesday.
“I want as soon as possible to be able to prove my innocence. I am fighting for this, I am in Brasilia to prove my innocence. I have nothing to run from, I have nothing to fear, I have nothing to hide,” he said. .
According to the statutes, the parliamentarian will have five working days to present her defense.

Notification attempts
The Department of Internal Affairs had already made two notification attempts last week, in the office and in the functional department of the deputy in Brasilia, but they did not find her.
At the request of the deputy, the Division of Internal Affairs also held a preliminary hearing with the parliamentarian. The procedure, however, does not count as the formal delivery of the deputy’s defense.
The magistrate of the Chamber, Deputy Paulo Bengston (PTB-PA), said that the term for the defense should start from Thursday (10). By regulation, once the defense has been delivered, you will have 45 business days to send your opinion to the Board of Directors of the Chamber (see below).
“I believe that this period will be shorter, we are estimating, in a working group that we are doing in the Department of Internal Affairs, that within 15 days at most, this opinion will be ready and, thus, the case will continue for the commission and the ethics council “. Bengston said.
Flordelis, however, has parliamentary immunity and can only be arrested on the spot for a heinous crime or when there is a final judgment for loss of mandate.
Another way is the loss of mandate due to non-compliance with parliamentary decorum, which needs to be approved by their peers in the Ethics Council and, later, by an absolute majority in the plenary session of the Chamber.
According to the Constitution, a deputy or senator who has a procedure “declared incompatible with parliamentary decorum” will have his mandate revoked.
These complaints are analyzed by the Chamber’s Ethics Council, which decides whether or not a mandate is lost. Then, the process goes to the Plenary of the Chamber, which needs an absolute majority (that is, a minimum of 257 votes) to define the termination or continuation of the mandate.

However, only parties with representation in Congress or the Board of Directors can request the revocation of a mandate directly to the council.
In the case of Flordelis, the request was made by the deputy Leo Motta (PSL-MG), which makes the process slower. Before the request reaches the Ethics Council, it is up to the House Internal Affairs Department to conduct a preliminary analysis, which will then be sent to the House Board of Directors.
The House Ethics Council has been detained since the start of the pandemic, as well as the other House committees.
On Wednesday (9), however, a draft resolution must be voted on allowing some collegiate bodies to function remotely, including the Ethics Council.
