BRASILIA – After disagreements between parliamentarians in the voting session of the Provisional measure (MP) 910, which deals with regularization land ownership in Amazon, parliamentarians decided to lose the initiative duration. The obstruction of opposition parties and the expression of fear by some deputies from the center led the MDB leader, Baleia Rossi (SP), to propose that the issue be addressed in a bill, to be voted next week. . The president of the Chamber of Deputies, Rodrigo Maia (DEM-RJ), tried since last week to adapt a voting agreement for this afternoon. If the House approves it, the Senate would still have to be voted by the Senate until next Tuesday, the deadline for the new rules to take effect. With the stalemate, still in plenary session, Maia communicated through the Whatsapp to the president of the Senate, Davi Alcolumbre, about the possibility of addressing the issue through a bill. According to the deputy, there was no objection from Alcolumbre.
Maia estimated that there was a consolidated majority due to approval of the matter, but took into account opposition complaints that the matter was resolved with little discussion.
– What I propose is that we can, a proposal already made by the MDB, present the project next Wednesday, so that the majority can exercise (their right) – Maia said.
The text will be the same as that of the deputy’s rapporteur, deputy Zé Silva (SD-MG). It altered two important sections drawn up by the government that were disputed by the Casa’s environmental group. Despite this, the group took a position against the vote because it understands that the new set of rules encourages fraud and land disputes.
Zé Silva says that he contemplated the current legislation in his text. The MP will not change the deadlines for land occupation defined by the Forest Code and the law passed in 2017 that deals with the regularization of land in the Amazon.
– What did I do as a rapporteur? I will not change the law. I will send a different message. Do not occupy more land, because the Chamber will no longer legalize you, says Zé Silva.
In addition, it changed the government text regarding the inspection exemption so that the owner receives the title to the land. The government wanted the exemption to be the norm in areas of up to 15 fiscal modules, an agrarian measurement unit used in Brazil, which takes into account different factors and varies from region to region.
In the deputy’s text, there are more facilities for those who have an area of up to one fiscal module, without inspection. The amendment aims to benefit small farmers and families who have not yet managed to regularize their situation. From two to six modules, there will be ten conditions for regularization. Although the analysis of the land is carried out by means of “remote monitoring”, using satellite images, the owner will be obliged to present, for example, the regular Rural Environmental Registry (CAR) and not have workers in conditions similar to slavery.
– The worst thing will be not voting. My report provides legal certainty, social justice. If not, what will happen? No one owns anything. I have the prospect of having 214 thousand people served. If you own your (land), you will be careful.
In the legal Amazon, a tax module corresponds to a maximum of 110 hectares. Since 80% of the area needs to be preserved, according to environmental legislation, only 22 hectares can be exploited for agriculture or other economic activities.
Despite considering the important changes, the environmental group still sees risks with the text. The president of the Environmental Front, Rodrigo Agostinho (PSB-SP) says that the group and part of the opposition must obstruct.
– Obviously, regularizing without inspection (up to six modules) is always a risk and Incra may be regularizing on indigenous lands, in an area of quilombola not yet recognized. So there are a series of conflicts over land that can continue to happen, says Agostinho.
The deputy says that Maia guaranteed that there will be no setbacks in the concessions already made by the rapporteur. He says that even then, there will still be legal uncertainty.
