The Superior Court of Sports Justice (STJD) of Volleyball judged the athlete Carol Solberg on Tuesday for having shouted “Fora, Bolsonaro” during the live broadcast, after winning the bronze medal in the first stage of the Brazilian Volleyball Circuit of Beach. In an online session, Carol was warned based on article 191, which refers to compliance with competition regulations: “not complying with, or making it difficult to comply with general or special competition regulations.”

The 1st STJD Disciplinary Committee of the Brazilian Volleyball Confederation voted in the trial, made up of five auditors: Otacílio Soares de Araújo (president), Robson Luiz Vieira (vice), Gustavo Silveira, Rodrigo da Paz Ferreira Darbilly and Marcos Eduardo Bomfim. Carol was defended by attorneys Felipe Santa Cruz, current president of the Brazilian Bar Association (OAB), and Leonardo Andreott, former president of the Volleyball STJD itself.

Regarding 191, two of the Commission’s auditors, Gustavo Silveira and Marcos Bomfim, voted for the athlete’s acquittal. However, the majority vote, formed by the rapporteur of the Robson Vieira case, the auditor Rodrigo Darbilly and the president of the Otacílio Araújo Commission prevailed. The three converted a fine between R $ 400.00 and R $ 1 thousand into a warning.

As for 258, only Otacílio Araújo did not acquit the athlete, turning the suspension of a tournament also into a warning. As a result, a majority of four votes in favor of the non-sanction prevailed in this case.

– The educational, pedagogical measure, I think it can be achieved. If in the future he repeats the expressions on the court in a way other than that directed at sports, he could be sanctioned with a worse penalty, said the president of the Commission, Otacílio Araújo, at the trial.

Subsequently, the Deputy Attorney General of the Superior Court of Sports Justice (STJD) of Volleyball, Wagner Dantas, forwarded the complaint to the STJD secretariat. The trial was already scheduled for Tuesday, October 6, but even before it happened, it was postponed after the Brazilian Press Association (ABI) and the National Movement for Human Rights (MNDH) requested to participate in the process. Last Friday the 9th the request was rejected and the trial was rescheduled for this Tuesday.

It is also worth mentioning that Carol, to participate in the National Beach Volleyball Circuit, previously signed a term in accordance with the competition regulations, which says in item 3.3: “the player agrees not to reveal, through the media, your personal opinion or information that reflects criticism or may, directly or indirectly, damage or tarnish the image of CBV and / or the sponsors and commercial partners of the Contests “.
