BRASILIA – President Jair Bolsonaro signed a decree this Thursday to create NAV Brasil, first state-owned company established in the federal government since 2013. The public company will be responsible for the control of Brazilian airspace, an assignment that until now was with Infraero. In November, the president signed a law that allowed the creation of the company that was effectively created with the signing of the decree.

NAV is the result of the spin-off of Infraero, which manages public airports such as Santos Dumont, and will maintain revenue from air navigation fees. The company will be linked to the Ministry of Defense, through the Air Force Command, and will inherit about 2,000 Infraero employees who already work in the air traffic control area.
According to the government, the intention is to reduce the loss of Infraero, which lost revenue after the privatization of profitable airports, and concentrate the services that will not be privatized in the new company. The infrastructure ministry plans to transfer all the airports managed by Infraero to the private sector and leave the state company only with regional terminals.

“The creation of NAV Brasil SA reinforces the relevance of air navigation services, optimizing the organization of the air transport sector. It should be noted, however, that the measure does not represent an increase in the State’s participation in the economy, since the creation of the new entity results from the spin-off of the current INFRAERO. It is a mere specialization, rationalization and efficiency gains “, states the note from the Sub-Office of Legal Affairs of the Presidency of the Republic.
The provisional measure that created the NAV was sent to Congress by former President Michel Temer in December of last year. In May of this year, the Bolsonaro government revoked the creation through another deputy, since this issue blocked the House voting agenda. Once the problem was solved, the deputy spent in two days, in the Chamber and in the Senate.

Before the presidential sanction, the Secretary of Privatizations of the Ministry of Economy, Salim Mattar, criticized the creation of NAV, saying that the company was “a thing of the past government” and that its creation was not guaranteed.
The new state-owned company incorporates all assets and liabilities related to air navigation currently concentrated in Infraero. Initially, Infraero employees linked to air navigation will be transferred to NAV Brasil, which include services such as telecommunications, radio stations, control towers and meteorological measurement.

The Air Force will continue to be responsible for the area of navigation infrastructure linked to defense and national sovereignty. The text specifies that the new company, due to its functions and the integrated structure of the Brazilian Airspace Control System, will act in a complementary manner to maintain sovereignty over Brazilian airspace.
