The decision was reported to the Federal Supreme Court (STF) by the Attorney General’s Office (AGU) on Thursday (26). The investigation has been paralyzed since September 17 due to the uncertainty about the testimony of the President of the Republic.

This AGU request on the conclusion of the investigations will be analyzed by Minister Alexandre de Moraes, rapporteur of the case since October.
According to the investigation, Bolsonaro has the prerogative to remain silent in the event of a statement. Even if the Federal Police fix a date, Bolsonaro can miss an appointment without being sanctioned. In 2018, the STF prohibited the so-called “coercive driving”, when it was required that the investigated or the accused testify.
The president’s hearing is identified as one of the last measures for the outcome of the investigations.
The opening of the investigation was authorized at the end of April and is based on the complaint by former Justice Minister Sergio Moro, who resigned alleging Bolsonaro’s alleged attempt to interfere with the Federal Police to protect family members and allies.

The rapporteur also determined that Moro’s defense could accompany the interrogation and ask the president questions. AGU appealed and, in plenary, the trial was only open to the vote of Minister Celso de Mello himself, who withdrew the following week.
