This week will be decisive for the PGR (Attorney General’s Office) to conclude if it will denounce President Jair Bolsonaro for privileged passive corruption, obstruction of justice and administrative defense for trying to interfere with the autonomy of the Federal Police.
From Monday (11) to Thursday (14), three state ministers, six delegates and a federal deputy must testify in the investigation that investigates the veracity of the accusations of former judge Lava Jato Sergio Moro against the executive president.
In addition, the minister Celso de Mello, of the STF (Supreme Federal Court), may decide in the next few days to announce the video of the ministerial meeting in which Bolsonaro would have threatened Moro with resignation if he had not changed the director general of the PF.
In this investigation, Bolsonaro can be denounced by the PGR and, if the Chamber approves the continuation of the investigations, he will be automatically removed from his post for 180 days.
The video-recorded ministerial meeting was quoted by the former minister in testimony to the PF. Interlocutors at the Planalto Palace fear that the disclosure of the recording will generate an even greater crisis, as people present say that, at that time, other ministers would have harshly criticized the judicial and legislative powers.
Celso de Mello allowed the former minister, the PGR and Bolsonaro to view the video, “in one act,” before deciding whether to keep it confidential or not. This will happen, according to the former minister’s lawyer, Rodrigo Sánchez, on Tuesday (12).
Moro will return to Brasilia for the first time after his resignation to follow the transmission of the video. He has been spending the last few days in Curitiba.
When he resigned from the Ministry of Justice and Public Security on the 24th, Moro said that the president wanted to force him to change the FP general director, Maurício Valeixo, to put someone of his direct contact in office.
On the morning of that day, Valeixo’s dismissal was published in the Official Gazette. This Monday, he will go to the PF as a witness in the investigation investigating the ex-minister’s accusations.
The goal of the change would be to facilitate Bolsonaro’s access to intelligence reports and details of ongoing investigations, violating the corporation’s autonomy as provided by law.
The executive director chosen to command the PF and operate its requests within the corporation, according to Moro, would be Alexandre Ramagem, who will testify on Monday. The investigators consider that the hearing is one of the most important because Ramage is considered a key piece in the episodes reported by Moro.
Current director of Abin (Brazilian Intelligence Agency), he is close to the Bolsonaro family and, after Moro and Valeixo resigned, he was even appointed to command the PF.
However, STF Minister Alexandre de Moraes vetoed his inauguration because he understood that the election did not respect the principles of morality and impersonality. In light of the Supreme Court decision, the president appointed Rolando de Souza, Ramage’s right-hand man in Abin, to the post.
Another Moro accusation is related to Bolsonaro’s insistence on changing the FP superintendent in Rio de Janeiro.
First, in September last year, he pressed until Moro accepted the exchange of Ricardo Saadi for Carlos Henrique Sousa as head of the corporation in the state of Rio de Janeiro.
The replacement, however, would not have been enough, and Bolsonaro would have followed him with the intention of changing the leadership of the FP in RJ. On Monday (11), both will testify.
In addition to the two, two other delegates must also be heard: Alexandre Saraiva, who was summoned to take over the corporation, and Rodrigo Teixeira, responsible for the stab investigation that Bolsonaro conducted when he was running for president in 2018.
When asking that the delegates be heard, the Attorney General of the Republic, Augusto Aras, declared that they are essential to investigate the “eventual sponsorship, direct or indirect, of the private interests of the President before the FP”.
On Tuesday, it will be the turn of three government ministers to testify simultaneously, to avoid combining versions. They were summoned for being summoned by Moro as witnesses to the president’s attacks to interfere with the PF.
Augusto Heleno (Office of Institutional Security), Walter Braga Netto (Casa Civil) and Luiz Eduardo Ramos (Secretary of Government) will be heard. Investigators from the Federal Police and the Office of the Attorney General (PGR) will participate in the statements.
Finally, on Thursday the hearing of the deputy Carla Zambelli (PSL-SP) will take place. The former Justice Minister issued messages exchanged with the parliamentarian as proof that he would not have accepted Bolsonaro interfering in the PF.
In the conversation that took place before Moro resigned, Zambelli asked Moro to accept the change in command of the PF and not break with Bolsonaro to be nominated for a vacancy on the Supreme Court.
In the messages, first, Zambelli asks Moro “please” to accept Alexandre Ramagem in charge of the PF. “And go to the STF in September. I promise to make JB promise,” added the deputy. Moro then replied, “Darling, I am not for sale.”
There is also an expectation regarding the release of the video of the meeting in which Bolsonaro allegedly threatened Moro. Minister Celso de Mello allowed the PGR, Moro and Bolsonaro to view the entire recording before deciding whether to make the recording public or only part of it.
Rather, the magistrate should await an opinion from the Attorney General on the matter. The dean of the STF announced that he will decide “soon” on the matter.
In the request to open an investigation, Aras declared that eight crimes could have been committed in the episodes narrated by Moro: ideological falsehood, coercion in the course of the process, administrative defense, obstruction of justice, privileged passive corruption, embezzlement, denunciation libelous and crime against honor
According to PGR interlocutors, Moro can be included in the last three and Bolsonaro in the first six.
Bolsonaro is being investigated for ideological falsehood due to the dismissal of Valeixo from the general leadership of the PF, published in the Official Gazette with Moro’s signature.
Upon resigning, the former minister said he did not endorse the publication and did not even hear that it would go away. Hours later, the Official Gazette was republished without the signature of former judge Lava Jato.
