The President of the Republic, Jair Bolsonaro, went to the Federal Supreme Court (STF) on Tuesday afternoon (13) to meet with Minister Luiz Fux, president of the Court.

The Planalto Palace did not report the order of business for Tuesday’s meeting. This is the first official hearing between the two heads of power since Fux took office. The minister assumed the presidency of the Supreme Court on September 10, in an act in which Bolsonaro was present.

The hearing is also the first after Bolsonaro appointed Judge Kassio Nunes Marques, of the Federal Regional Court of Region I, to a position in the STF.

Kassio was chosen to replace the then dean of the court, Minister Celso de Mello, who retired on Tuesday. Kassio’s appointment, which was endorsed by STF ministers Gilmar Mendes and Dias Toffoli, must be approved by the Senate.

Last week, in his dismissal, Celso de Mello voted in favor of Bolsonaro giving testimony in person, and not in writing, in the investigation that investigates whether the president interfered with the Federal Police. The trial has been suspended.

Decision of Minister Marco Aurélio

Another issue under discussion in recent days involving the Supreme Court was the decision of Minister Marco Aurélio Mello to free the drug trafficker André do Rap, one of the chiefs of the First Command of the Capital (PCC), a criminal faction that acts within and outside the prisons of São Paulo.

The minister granted habeas corpus and the drug trafficker was released from jail on Saturday (10). To justify his release, Marco Aurélio cited an extract from the anti-crime package, approved by Congress last year and sanctioned by Bolsonaro, which determines the release of prisoners when there is no periodic review of the need for preventive detention. Thus, in the case of the trafficker, the “illegal coercion” of the prison was demonstrated.

Still on Saturday, Fux suspended Marco Aurélio’s decision and ordered the arrest again, at the request of the Attorney General’s Office.

André do Rap was not found. The Public Ministry and the Federal Police believe that he fled by private jet to Paraguay or Bolivia.

The STF informed that Fux will take the case of the merchant for the analysis of the plenary of the court on Wednesday (14).
