President Jair Bolsonaro confirmed in his weekly live broadcast on Thursday (1/10) that he elected Judge Kassio Marques, of the Regional Federal Court of Region I, for the vacancy of Minister Celso de Mello, who leaves the Federal Supreme Court in the next day 13.
According to the president, the nomination will be confirmed in this Friday’s edition of Union Official Gazette.
After the publication, Marques will still have to undergo a hearing in the Senate and have his name approved in plenary session, by an absolute majority of senators. The rite is defined by the Constitution.
The main feature of Marques is discretion. His peers consider that he has technical density and has shown courage in firm decisions, which stand out for their solid legal basis.
It is also evaluated that his appointment reflects fatigue due to the excessive appreciation of academicism. The number of degrees has not been considered a good thermometer for choosing judges.
In an interview with Federal Justice Yearbook In 2019, other trademarks of the judge stood out: productivity, making more than 600 decisions per day; and the defense of the implementation of new management and computerization techniques.
Born in Teresina (PI), he worked as a lawyer until 2011, the year in which he joined TRF-1. From 2008 to 2011, he was also a judge of the Regional Electoral Court of Piauí. The judge has a master’s degree from the Autonomous University of Lisbon, where he also did a doctorate. With two postgraduate degrees, he is a postgraduate professor in Corporate Law at Ibmec-DF. He represents the fifth constitutional law firm of the TRF-1, where he held the vice presidency until April 2020.
He was already considered for a place in the STJ, in 2015. He currently chairs the 7th Panel of TRF-1.
If Nunes is confirmed in the Senate, he will be the first member of the Republican history of the STF to graduate from the Federal University of Piauí (UFPI), and the sixth of Piauí origin.
According to data from the website of the Supreme Court, most of the ministers who already served in court during the Republic, 55 of them, including three of the current ones, attended the Largo de São Francisco Law School, which for It has long belonged to the University of São Paulo (USP). The second largest number is from the Olinda School of Law, which later became Recife and currently belongs to the Federal University of Pernambuco (UFPE): 40 graduated from there. The old Law School of the University of Brazil, today part of the Federal University of Rio de Janeiro (UFRJ), adds 21.
In addition to the 40 graduates in Pernambuco, another seven graduated from educational institutions in the northeast. None of these seven corresponds to any of the current ministers, and none of the schools is from Piauí like the UFPI.
Regarding the state of origin, the Southeast region concentrates most of the magistrates who passed through: 33 Cariocas (four current), 30 miners (one current, Cármen Lúcia) and 25 São Paulo (three current, including the dean about to leave ), in addition to a capixaba. But the Northeast region also has important numbers: 52 ministers from nine different states, 14 of them concentrated in Bahia.
Piauí de Kassio Marques had five representatives among these 52. A citizen of Piauí has not held the position of STF minister since 1991, when Aldir Passarinho reached the mandatory retirement age. If Marques is confirmed for Celso, he will be the only Northeast member of the current roster.
“Take it from the serene”
According to Mônica Bergamo’s column published earlier, in Folha de S.PauloBolsonaro was recommended to officially sanction the decision to remove Kassio Marques from the “serene”, that is, to prevent him from continuing to be bombarded by groups opposed to the nomination and also by other candidates for office.
With the officialization of the election, the fact would be fulfilled and would remain to mark the day in which the senators would savor it.
For the officialization to take place in a short time, there was another problem to be solved, according to the journalist: that it does not seem an inelegant gesture with Celso de Mello. The interlocutors would have consulted the magistrate to explain the situation. It is customary for the president to be appointed only after the incumbent retires.
