A black candidate failed to evaluate the quota system of a prosecution contest for being “pretty.” The evaluation is from the Federal District Court of Justice, which determined that the woman must enter the vacancy to which she was admitted in 2018.

According to Uol, Teófilo Caetano, responsible for the case, understood that the economist Rebeca da Silva Mello, 28, was eliminated from the event because the examining board considered that she was not discriminated against for being “beautiful” and not having physical characteristics associated with people black. , such as “curly hair, extremely sharp nose and lips and the black skin color shown,” the judge wrote in the decision.

For the magistrate, Cebraspe, organizer of the contest, adopted a “subjective” criterion in relation to Rebeca. The evaluation would have been in the opposite direction to the quota system, “designed to eliminate and repair historical inequalities.”

In a statement made to the Justice during the judicial process opened by the economist, Cebraspe affirmed that, to enter through the quota system, the person must be considered dark and also have “phenotypic characteristics of blacks.”

Rebeca, who according to a court ruling turned out to be a descendant of quilombolas, requested in 2018 the position of administrative technician of the MPU (Public Ministry), a position whose starting salary is around R $ 7,000 per month.

After passing the test, she was called in for an interview to check her black characteristics, such as phenotype. However, a panel of three evaluators disqualified the candidate on the grounds that she was not entitled to the quota system.

In its defense before the court, Cebraspe said that “the fact that a person is not white does not necessarily mean that he is black.”

“Brown, for the purposes of the inclusion policy in focus, should be understood as black with fair skin, and should present, regardless of having a lighter skin color, phenotypic characteristics of black people, who served throughout their lives. life as an obstacle, putting her on the sidelines of society, ”said Cebraspe attorney Daniel Barbosa Santos.

According to the Statute of Racial Equality, the black population is made up of people who declare themselves black or brown, the criteria defined by the IBGE (Brazilian Institute of Geography and Statistics). The legislation does not state that, to be eligible for the black quota system, the candidate must have suffered or suffer discrimination.

For Rebeca, Cebraspe’s argument doesn’t make sense. “I’m black, but can’t I be in favor of the quota system? It’s crazy,” she said.

The bank denies prejudice
In contact with Uol, Cebraspe denied that there was prejudice in the bidding and said that the candidate’s physical characteristics prevented her from being selected as a shareholder. “There is no mention, in the attractiveness of this center, of a standard of beauty or any prejudicial argument,” said the consultant for the organization of the contest.
