The Federal Police was baffled by the profound changes in the administrative structure of the corporation. It started with the departure of Sergio Moro from the Ministry of Justice, who was seen as a defender of PF’s independence in government and has respected a large part of the corporation since Operation Car Wash. Superseded by Andr Mendona, known for his deep alignment with President Jair Bolsonaro, he fears that the PF will be hampered. But what appears to be confirmation that the judicial police’s scope of action would be restricted came with the placement of Rolando Alexandre Souza, former number 2 of the Brazilian Intelligence Agency (Abin) in charge of the PF – home solution to impediment, determined by the Supreme Federal Court (STF), appointed by Alexandre Ramagem, who, for now, remains in front of the Araponga.
Moro’s departure would be troubling, but he turned on the red light in light of accusations he made of President Jair Bolsonaro of interfering with the Federal Police, trying to gain access to police intelligence reports and insisting on the change of the director general and the superintendent of Rio de Janeiro, the state where his electoral base is located. There, at least five investigations are of interest to the Bolsonaro family, including the investigation of unusual movements in the accounts of Fabrcio Queiroz, former parliamentary assistant to current Senator Flvio Bolsonaro (Republicans-RJ). The investigation remains confidential, but is directed at people close to the President and his children.
In a petition sent last Thursday to the Supreme Court, Moro reinforced the allegations he had made and “highlighted the relevance of the President of the Republic’s incisive statements” at a ministerial meeting, “especially linked to the desire to change the general direction of the PF, from the superintendent of Rio de Janeiro and even from the Minister of Justice himself, in addition to the intention to obtain intelligence reports from said police agencies. ”In fact, after the dismissal of the then director general, Maurcio Valeixo, and the departure de Moro, the FP superintendent in Rio, was changed Carlos Henrique Oliveira, who had high approval from agents and delegates, gave way to Tcio Muzzi, who became in charge of the unit for five months last year .
Muzzi’s choice was a relief, since he has no proximity to Bolsonaro. He worked in Lava-Jato and has been in the PF since 2003, he held the position of chief of the Police Department against Corruption and Financial Crimes, of the Rio Superintendency. In addition, he was deputy director of the Department of Asset Recovery and International Legal Cooperation and headed the National Penitentiary Department (Depen). With a technical profile, Muzzi will be challenged to keep ongoing investigations safe from political interference.
Carlos Henrique Oliveira will be the executive director of PF, number 2 of the corporation. Although the government claims that this is a promotion, in practice the delegate “fell to the top”: he left the research area to act in the control of ports, airports and border regions, in addition to dealing with administrative matters.
Uncertainties
For the legal director of the National Federation of Federal Police (Fenapef), Flvio Werneck, uncertainties hinder the work of the PF. He explains that the power of the President of the Republic to elect the CEO of the corporation was instituted by a provisional measure, in the Dilma government, and that it quickly passed through Congress. “This situation of taking the discussion of positions to the Judiciary is very bad. We understand that both the first nominee and the now appointed director meet legal requirements. But the political issue is difficult to debate. Since 2014, unfortunately, or fortunately, the election of the President of the Republic. We, from the Federation, went against this legislation ”, he explains.
According to Werneck, even more autonomy is needed in investigations, and the police yearn for the creation of an organic law. “What we love the most, 31 years ago. In order to regulate what the duties are, what is obligatory, the rights and duties inherent to the positions and how federal police officers will be treated within their careers, ”he says, emphasizing that they also want investigative autonomy.
Judicialization
An act by the Minister Alexandre de Moraes, of the Supreme Court, prevented Bolsonaro from appointing delegate Alexandre Ramagem –– friend of President 02’s son, Councilman Carlos Bolsonaro –– to command the corporation. The magistrate saw, based on Moro’s statements, the risk that Remage would act in favor of the interests of the First Family within the PF. Ramage continues to occupy the position of CEO of Abin, but everyone in the PF believes that he is the one who gives the cards in the organization.
The perception that Rolando Alexandre Souza, former number two of Abin, will be just an iron front for Remage. For police officers, Rolando approached the agency that advises the president on the intelligence sector of the judicial police. “This is a disturbing and historic lineup. These are jobs that can speak to provide the best service to society, but the FP cannot act in the service of the president. Within the corporation, this alignment is taken for granted on some issues, ”says a source in the PF, contacting the report.
