After a day of many inconveniences, the buses returned to circulate normally in Gran Vitória this Tuesday (9). Early in the morning, the online newspaper Folha Vitória contacted eight of the eleven companies that are part of the Transcol System and all confirmed the return of activities.

Until Monday night (8), only the groups of the Santa Zita and Nova Transportes companies served the population. They left the garages that are in Marcílio de Noronha, in Viana, and in São Francisco, in Cariacica, and went to the respective terminals and end points.

Limit

The Labor Court granted a judicial order that determined the end of the blockades carried out by Sindirodoviários in the garages of two companies that are part of the Transcol System. The document was issued late Monday afternoon and the fleet was expected to gradually return. However, the passengers who were in Vitória waited for hours at the points in the hope of getting home.

In the precautionary measure, the federal Labor Judge, Gerson Fernando da Sylveira Novais, pointed out that the demonstration, promoted by Sindirodoviários, took users by surprise and that few buses left the garages. As a result, there was overcrowding, “increasing the danger of collapse due to the covid-19 pandemic,” the text says.

While health professionals desperately ask for the collaboration of society to reduce infections, relieve hospital beds, and most of these health professionals are on the verge of exhaustion, it is necessary that all compete for compliance with these orders, especially those who exercise. essential activity as collective transport sounds “

The judge also described that he does not consider the stoppages that occur for the same reason reasonable, since “the collectors are guaranteeing employment, and it is true that there is an agreement in this regard, with the approval of the state government, receiving wages, even when they are out of the activity, while thousands of other professionals depend on emergency assistance because they are unemployed and without a salary ”.

The new court order was granted requiring union representatives to stop hindering employees’ access to garages, under penalty of a daily fine of R $ 100 thousand reais per day of non-compliance.

In a note released after the preliminary injunction, the Union of Metropolitan Transport Companies of Gran Vitória (GVBus) reported that the expectation is that the decision will be fulfilled and that, gradually, the entire system will operate again.

Stop

Since 4 am on Monday (8), conventional buses have been prevented from leaving the garages. in Greater Victoria. Highway workers held the protest calling for the return of the collectors, who were removed from their duties in May last year. With the strike, the bus stops in Grande Vitória were full and many had difficulty getting around.

Authorization

The collectors have been out of their duties since May 17 of last year. In principle, the removal would be for two months, as allowed by an interim measure. Nevertheless, this period has been extended for a longer period, after the extension of the deadlines for companies and employees to sign contracts for the proportional reduction of working hours and wages and temporary suspension of the employment contract.

The removal of the collectors was one of the measures adopted by the Government of Espírito Santo to prevent the spread of the new coronavirus. Without the presence of professionals in the groups of the Transcol System, the only way to pay the fee in this period is through the GV Card, that is, provisionally, the circulation of cash in groups is also prohibited.

The text of the ordinance considers the publication of Federal Decree 10,470, of August 24, 2020, and 10,517, of October 13, 2020, which adds in another 180 days the suspension of these employment contracts, in order to complete the 240 days total. . As a result, the deadlines for the proportional reduction of hours and wages and the temporary suspension of the employment contract and for the payment of emergency benefits are extended.

“They will not be fired”

This was not the first demonstration by road users for the same reason. On January 4, 2021, first business day of the year, Sindirodoviários initiated a protest that lasted at least three days. It all started with preventing the buses from leaving the garages. In the following days, they made their way to the terminals and released the turnstiles, allowing passengers to enter without paying fare.

On all occasions, the Secretariat for Urban Mobility (Semobi) reinforces, in notes or interviews, that collectors will not be fired. At that time, the folder stated that “the continuation of the suspension of cash collection in groups was defined taking into account the Decree on the state of emergency in public health in the State of Espírito Santo, which establishes sanitary and administrative preventive measures , control and containment of risks, damages and injuries derived from the outbreak of a new coronavirus (COVID-19). Consequently, the function of collector within the groups is also suspended based on the same decree “.

On Monday, before a new demonstration, Secretary Fábio Damasceno reinforced the information that the collectors have stability and will not lose their jobs. “It is a category that is being contemplated and we are managing to keep wages, employment, stability up to date and have a voluntary layoff plan. Few in Brazil will go through this moment in such an objective way. Many parents are being fired and losing their job. support”. , “he said.

Damasceno stressed that, added to the issue of rains, the closure affected important sectors at this time, such as vaccination against covid-19. “Today we had the subject of rain, vaccination. Many elderly people could not be vaccinated today, because the health post was closed, due to the rain and public transport. This causes outrage. This is not the time for this. Now is the time. to dialogue, find a way, speak and not make those kinds of decisions, which is irresponsible ”, he concluded.
