The measures will be analyzed by the minister who reports the case in the Federal Supreme Court (STF), Celso de Mello. It will be up to him to authorize the depositions and send the measures to comply with the PF.

Aras’s orders focus on four fronts:

  • testimonies of people mentioned by Moro in the testimony;
  • audio or video recovery that proves the alleged interference attempt;
  • verification of the signatures of the exoneration act of the former general director of PF Maurício Valeixo, and
  • experience in the information obtained from Moro’s cell phone.

Please understand each of the requests below.

In the request to the STF, Augusto Aras requests that the PF take testimony from 10 people cited or related to the accusation made by Moro when he left the Ministry of Justice and Public Security, on April 24. The list consists of:

  • Minister of the Government Secretariat, Luiz Eduardo Ramos;
  • GSI Minister, Augusto Heleno;
  • Minister of the Civil House, Braga Netto;
  • deputy Carla Zambelli (PSL-SP);
  • former director general of the Federal Police Maurício Valeixo;
  • The delegates of the FP Ricardo Saadi, Carlos Henrique de Oliveira Sousa, Alexandre Saraiva, Rodrigo Teixeira and Alexandre Ramage Rodrigues.

These people should be heard, according to the head of the PGR, on “possible sponsorship, direct or indirect, of the private interests of the President of the Republic before the Federal Police Department, in order to occupy positions in commission and exonerate their occupants. ”

For all the testimonies, Aras suggests a period of five days from the summons mentioned. The deadline is the same given by Celso de Mello for Moro’s audience last week.

Aras also asks Celso de Mello to order the General Secretariat of the Presidency of the Republic to send a copy of the “audiovisual records” of a meeting between Bolsonaro, ministers and presidents of public banks at the Planalto Palace, on the 22nd. of April.

The intention, according to the document, is to confirm Moro’s claim that Bolsonaro would have demanded, at this meeting, the replacement of the PF director general and the corporation’s superintendent in Rio de Janeiro, in addition to “intelligence reports and information from the Federal police. ”

Signature Verification

Aras also asked the Supreme Court to determine the presentation of “evidence of authorship and integrity” of the signatures in the act that exonerated the former general director of PF Maurício Valeixo.

Initially, the decree was published in the “Diário Oficial da União” with the digital signatures of Jair Bolsonaro and Sergio Moro. At a press conference hours later, Moro denied signing the document, indicating possible fraud in the publication.

The same day, an additional edition of “Diário Oficial” republished the event, this time signed by Bolsonaro and the ministers Walter Souza Braga Netto (Casa Civil) and Jorge Oliveira (General Secretariat). In the official justification, it was stated that the text was reissued for “material error”.

Mobile data expertise

Another measure requested from the Supreme Court is the analysis of the material reflected on the cell phone of the former Minister of Justice. In addition to a deposition of more than eight hours, last Saturday (2), Moro also offered the PF data from the cell phone.

Moro was heard last Saturday (2) for more than eight hours at the Federal Police headquarters in Curitiba. The testimony was taken in a large room and everyone wore masks, following the recommendations of the health authorities to deal with the coronavirus.

TV Globo discovered that the PF extracted from the ex-minister’s phone the evidence that he had already shown: WhatsApp conversations with President Jair Bolsonaro and with Deputy Carla Zambelli (PSL-SP). According to those same sources, Moro provided some new evidence, and mainly, indicated ways to obtain others.

The Jornal Nacional revealed the conversations that Moro indicates as evidence, which took place days before the replacements in the Ministry of Justice and the PF.

In one of the conversations, Bolsonaro sends Moro a report that says “PF in the queue of 10 to 12 Bolsonar deputies.” And he comments: “Another reason for the exchange.”

The president referred to the exchange of Maurício Valeixo, former director general of the Federal Police, appointed by Moro in 2019 and exonerated by Bolsonaro on 24.

Later, Moro explained to the president that all the decisions about this investigation were made by the STF minister, Alexandre de Moraes.

In the other conversation, Moro received a message from Congresswoman Carla Zambelli asking him to accept Alexandre Ramagem as PF’s new CEO. He ended up being nominated for the position, but his appointment was canceled by the STF.

Zambelli suggests, in the exchange of messages, that Moro accepts the indication of damage in exchange for a vacancy in the Supreme Court. Moro replied that “it was not for sale.”

Regarding the testimony of the authorities with the prerogative of being heard in a place, day and time previously established between them and the judge (art. 221 CPP), it is suggested to establish dates within 5 business days of the summons, prior communication from the Office of the Attorney General to monitor the proceedings.
