Alerj approves the report for the continuation of the impeachment process of Witzel | Rio de Janeiro

The rapporteur, Deputy Rodrigo Bacelar (SDD), read the 77 pages of the document for just over two hours, in the presence of 24 of the 25 deputies who make up the committee (see below who was in the plenary).

The deputies then spoke about the report and at the end cast their votes. PSC deputy Leo Vieira, the same party as the outgoing governor, also voted in favor of the report.

After the report was approved by the special committee this Thursday, the process will be analyzed in plenary next week.

This Friday (18), the Official Gazette will publish the result of the vote on the report. See below for the step-by-step impeachment process.

Step-by-step prosecution process

• The result of the vote on the report will be published in the Official Gazette on Friday (18).
• As of Monday (21), a period of 48 hours begins to count for the opinion to be inserted in the agenda of the plenary session of Alerj
• After 48 hours, the opinion can already be voted on Wednesday (23)
• The vote in plenary session can last more than one day.
• After the vote in plenary, the text is published in the Official Gazette.
• If the result is the accusation of the governor, the Court of Justice is notified to initiate the formation of the Mixed Court
• This court is made up of 5 deputies (elected by Alerj) and 5 judges (chosen by lot with criteria defined by the TJ)
• After the formation of the Mixed Court, a new stage begins where the governor is removed for up to 180 days while the court analyzes the issue.

In the reading, the rapporteur listed a series of complaints against the governor withdrawn by the STJ on August 28 after the Operation Tris In Idem, which investigates deviations of health resources in the government of RJ in emergency contracts.

The governor and eight other people, including the first lady Helena Witzel, were also denounced by the Attorney General’s Office (PGR) for corruption.

The discovery of the scheme began with the investigation of irregularities in the contracting of field hospitals, respirators and medicines to combat the coronavirus pandemic.

The deputy began reading shortly before noon. A large part of the document was dedicated to the requalification of the Instituto Unir Saúde and the contracts with OS Iabas.

The social organization Unir could not be hired by the government by the State Department of Health itself due to the precariousness of the services provided.

According to the Federal Public Ministry (MPF), the company is linked to the businessman Mário Peixoto, Favorite operation.

The operation preceded Operation Placebo, who points to indications that Witzel knew of fraud in the Health area. The revocation of the OS disablement is also under investigation.

“Unir Saúde could not provide the services and, even so, it was reimbursed by act of the governor, including the return to receive public money. This indicates a risk of damage to the treasury ”, said the rapporteur.

The deputy also included in his report the amounts of the payments made to the OS.

“In relation to the Unir Saúde Institute, the record of payments made by the State appears in the period in which it no longer had the necessary qualification and qualification requirements. Such information, obtained from the State Government Transparency Portal, indicates that There were payments in a period in which the Unir Saúde Institute was disabled, in the order of R $ 26.8 million, which indicates the existence of strong indications of damage to the treasury, since it was not even sought to protect the State against payment of services that had not always been and that, therefore, generated the most severe penalties for the contractor “.

In another section, the rapporteur listed the contracts with Iabas, a social organization investigated for irregularities in the contracts signed for the construction of field hospitals in Rio de Janeiro in the pandemic.

Because of these complaints, then-Governor Wilson Witzel removed Iabas from the administration of the state field hospitals in late June for construction work.

“Iabas’s work proposal was made on March 26, 2020 – the day before the State’s request. After a quick process, the contract was signed, in the form of a Simplified Term of Reference, for the implantation of hospitals in Campaign for the amount of R $ 835,772,409 78 – signed by Gabriel Neves, then Undersecretary of Health ”, said the rapporteur.

Regarding the contracts with Iabas, the rapporteur said that the contractual clauses were imprecise.

“In the manner described, the appropriate means of contracting would be the signing of a management contract, since in the agreed form there is an affront to the legal system; imprecise contractual clauses. Even if the contract is maintained, the agreement may be detrimental to management in various aspects.; Requests presentation of justification of advantages; indicates to the manager the need to adopt all measures for the reimbursement of surpluses already spent “.
