Aware that former President Eduardo Bandeira de Mello made a statement to the press alleging that, if he had still been manager of the club, there would not have been a fire in the facilities of the George Helal Training Center, the Board of Directors and the Presidents of Power from Flamengo. to clarify, for the avoidance of doubt, the facts practiced by the former president, as a club official, in the terms in which they were cited by the police authority, in the investigation that determines the responsibility for the fateful fire that occurred in the “Ninho do Urubu “
Initially, it was verified in the action presented by MPRJ, in the Children and Youth Court, which aimed to obtain better accommodation conditions for minors, that former President Bandeira de Mello personally attended the process to refuse to comply with the Adjustment Term of Conduct (TAC) proposed by the Public Ministry. In this process, it is said that, 6 (six) months before the tragic episode, the MPRJ carried out an inspection, which found a worsening in the conditions of the accommodations. In this regard, the police authority said the following:
“The disinterested line of action of former President EDUARDO BANDEIRA DE MELLO is corroborated in the records of the civil investigation initiated by the MP in 2015, when at that time he refused to sign the Term of Adjustment of Conduct (TAC) so that the situation precarious regularization of the base athletes of Flamengo, despite the fact that they admitted non-compliance with a series of related conditions in the survey.
The conduct of former President EDUARDO BANDEIRA DE MELLO led to the filing of a public civil action by the MP on March 23, 2015, which sought the immediate prohibition of the accommodation of players from the base of the club, when, on March 21 From 2015 to 2017, the club reported that the transfer of athletes from base to new accommodation would have occurred. However, the new accommodation was inspected by GATE / MP on June 18, 2018, where worsening conditions were reported, including with respect to the fire safety of the housing module. “
In addition, the police authority discovered that, during the administration of former President Bandeira de Mello, the CT “Ninho do Urubu” did not have the commercial license issued by the City of Rio de Janeiro or the Certificate of Approval issued by the fire department . Due to this, the Bandeira de Mello administration received several CT interception orders from the Rio de Janeiro City Council, which were not carried out, which led to several notices of infringement and fines. At this point, the police authority pointed this out and concluded:
“During the administration of former President EDUARDO BANDEIRA DE MELLO, the City Council issued the Notice of Interdiction for lack of the Operation Permit resulting, among other reasons, from the absence of the approval certificate from the Fire Department, with several notices of infraction written up. for breach of the prohibition until the date of the fire in the housing module.
It is not credible that former President EDUARDO BANDEIRA DE MELLO, from October 24, 2017 to December 31, 2018, on a matter of extreme relevance to Flamengo (construction of Ninho do Urubu), considered strategic for professional football and from the On base, he had ceased to be aware of the CT interdiction and subsequent infringement notices, having preferred this officer with final mastery of the fact to ignore state determinations, which, if followed, would have saved the lives of young athletes . “
These were the facts that served as the basis for the police authority to accuse former President Bandeira de Mello for the death of young athletes from Flamengo on February 8, 2019.
It is worth clarifying that, in 3 (three) months, the current management managed to obtain the provisional operation license of the CT “Ninho do Urubu”, the approval of the Fire Department and, in 6 (six) months, it obtained the definitive license. The previously rejected TAC was duly signed with the Public Prosecutor on May 21, 2019 and ratified by the judge of the Children and Youth Court, and it is certain that, since then, the George Helal Training Center has been fully authorized for athletes and also for use by minors.
The same process of regularization and obtaining a permit was carried out at the Gávea headquarters, which was also irregular, but is now regularized, with the approval of the Fire Department and the permit.
Finally, the current administration, supported by its Presidents of Power, clarifies that it is not accusing former President Bandeira de Mello of being responsible for the tragedy, but only reports the events found by the police authority, as exposed in the process, for a better understanding of their own accusations before the Rio press, as well as to demonstrate the management corrections and legalizations carried out by the current administration.
