President Jair Bolsonaro (no party) mentioned a “possible veto” to an attempt to resolve the impasse for the purchase of millions of doses of coronavirus vaccines manufactured by the Pfizer laboratory. The immunizer is the only one registered for definitive use in Brazil authorized by Anvisa (National Agency and Health Surveillance), but the government did not acquire it because it does not agree with a clause that exempts the pharmaceutical company from liability in case of adverse effects. .

The Pfizer vaccine is 95% effective overall and its safety has been certified by Anvisa. Today, in Acre, the Minister of Health, Eduardo Pazuello, stated that there is a legal impediment to make the purchase with the clause required by the company, but that, nevertheless, the government and Congress are negotiating a solution: a law in the Parlament. that would allow to acquire the immunizers even with this exemption from laboratory responsibilities.

At a press conference, Bolsonaro was asked if he would buy the vaccine from Pfizer, but he left the answer to Pazuello. “We are discussing the flexibility of the law for this, and it is up to me to comply with whatever comes,” the minister explained. “If authorization comes, we will buy Pfizer and Janssen, now it depends on high-level work.”

But after Pazuello explained, the president asked to speak. Bolsonaro said that the clause that exempts the company from responsibility “is something of extreme responsibility.” And then he mentioned a hypothetical veto if a law negotiated by Congress that exempts the laboratory from possible side effects passes.

“So, it is something of extreme responsibility [a] Whoever goes, in Brazil, has to give the last word. If it is me as president, if it is Parliament annulling a possible veto or if it is the Federal Supreme Court (STF), ”said Bolsonaro.

According to him, regardless of that, “all the clauses will be shown to the population, at the end of the line, so that everyone knows what is being applied.” Since the beginning of negotiations with Pfizer, Bolsonaro has been criticizing the terms of the contract proposed by the pharmaceutical company. He even proposed that the person who received the vaccine sign a liability waiver, but then backed down.

Negotiation between Pfizer and the government is stalled

Brazil has been negotiating with Pfizer since the first half of last year, but the deal is stalled. The Minister of Health, Eduardo Pazuello, considers that the laboratory imposes “leonine clauses” on the Brazilian government.

On Monday, representatives of the pharmaceutical company participated in a session in Congress and senators volunteered to mediate negotiations with the ministry. During the meeting, the pharmacists indicated that they will not renounce the conditions that they negotiate with pasta. One of them, for example, is that the government is liable for potential adverse reaction lawsuits.

In a note released yesterday, Pfizer reported that it cannot comment on the negotiations with the Brazilian government, but that “the clauses that are being negotiated are in line with the agreements that we closed in other countries of the world, including Latin America.”
