The primitive error, which translates into a kind of brake on institutional arrangement, was committed at that time by the then Army Commander, General Eduardo Villas Bôas, with his crazy tweet, which threatened the Supreme Court if the majority decided to grant habeas corpus to Lula – for example, with the Constitution and the Code of Criminal Procedure.
The general continued to err in granting subsequent interviews, stating that he had the support of the High Command and that he even considered the possibility of an intervention. In his words, therefore, the current regime in Brazil is a protected democracy. If the military doesn’t like this or that, they undo it.
The madness continued with the testimony provided for a book: it provides a service by detailing at least the general’s version. The testimony itself was unnecessary and inappropriate. Anyway, he didn’t bring anything new.
THE FACHIN-VILLAS BÔAS DOUBADINHA
Edson Fachin, the reporter for the oil company and, therefore, that HC, decided to react to the tweet from Villas Bôas three years late. I even wrote here that past bravery can be one of the names for cowardice. And I invited you to do the right thing now, voting, for example, on the suspicion of Sergio Moro.
I also remember that this HC was destined to be voted on by the Second Panel. Thinking that his position in favor of maintaining the prison could be defeated, Fachin decided to take the matter to the maximum, a prerogative that the rapporteur has. And, in fact, it got the expected result.
Don’t forget: that 2018 tweet from Villas Bôas was an effort to win the speaker’s vote: precisely that of Fachin. Who knows, due to the ghosts that could inhabit his consciousness, he decided to react to the general’s book, which did not bring anything new, on a hard note.
I put this reaction in the account of a “mistake” because, for that matter, it was absolutely irrelevant. I reiterate: that it does justice in the present.
THE GENERAL RETURNS TO CHARGE
Villas Bôas is a special advisor to the Office of Institutional Security. Regardless of the circumstances that led him to that position, the truth is that the author of that tweet should not participate in the government. But so it is, albeit in a discreet position. In any case, he held the highest position in the Army and enjoys prestige.
Instead of refraining from commenting, he took to social media to poke fun at Fachin. He wrote: “Three years later.” Yes, it is a fact! He did not do it to criticize the omission of the minister in 2018, of course!, But to trample him down. After the note, let’s say, the minister was the victim of a real virtual lynching promoted by the Bolsonar militias on the networks.
FUX LOADED
Today Luiz Fux gives an interview to Folha that barely conceals his thirst for leadership, placing himself at the center of the decision that led to the arrest of Daniel Silveira. The fact is that several ministers accused the president of the Court of a note condemning Fachin or of repudiation of the general’s reaction, who competed to further demonize the minister.
Fux was unwilling to accept the fight. He says in the interview that he had spoken with General Fernando Azevedo e Silva, Minister of Defense. He even reads a message Azevedo sent him. Institutional problems cannot be solved simply by talking behind the scenes. The president of the STF needed to give an answer that did not come.
Gilmar Mendes then decided to buy the fight. He wrote on Twitter that busy Tuesday:
“To the debauchery of those who must set an example, answer with firmness and historical sense: Never again dictatorship!”
After all, defending institutions requires more than whispering and exchanging messages.

As Fachin was under a pole and as the Supreme, due to his official voice, which is that of the President, was speechless, the hyenas smelled that smell of blood that whets the appetite and the spirit of the herd.
Daniel Silveira then decided to make that video and publish it. Fux says he was outraged. He would be willing to have the deputy arrested himself, as he was on duty, but he decided to call Alexandre de Moraes. It is quite possible that he will not deny his role if he talks about it, but I doubt that he will …
It doesn’t matter if things turned out the way Fux says or how they happened. The point is, and now back to the point, the sequence of errors ended up helping to make the story go. Azevedo e Silva, in fact, had spoken with the president of the STF. That eloquent silence that we heard negotiating with him, despite the fact that his colleagues demanded a demonstration in defense of Fachin, which never came?
The bombadão deputy decided to set fire to the playground. Now, since the appearance of Lava Jato in 2014, the Supreme Court has been Geni do Brasil. He got a lot out of the left, yes, in the PT government. But nothing that compares to what was seen with the alignment of bolsonhas and moropatas. It is good to remember that the 2019 marches demanding the closure of Congress and the Supreme Court had Bolsonaro as hero # 1 and Sergio Moro as hero # 2.

Silveira performed the prodigy of synthesizing in a video of just under 20 minutes all the hate campaigns that were carried out against the court during the two years of Bolsonaro’s government. You already know the content and I have already explained the difference between parliamentary immunity and crime. The flagrante, in addition, for a crime committed on the network, was absolutely characterized.
In its own way, the court shouted, “Fuck it!” And it set, and even took a long time to do, the limit. Others who decide to follow the Silveira path will find the same fate. And, of course, this will not prevent parliamentarians of the most varied subtitles from criticizing the decisions of the courts when they are the best.
For that, they have immunity and exercise freedom of expression.
