New rules of Brazilian traffic code (CBT) It will come into effect from April 2021. Thus, Brazilian drivers must comply with the new changes, including traffic offenses that will no longer add points to the National Driver’s License (CNH). However, it is worth noting that the violations are still in effect.

According to the new changes, no more points will be generated in the portfolio, bureaucratic penalties for the vehicle, such as aspects related to documentation: possession of mandatory documents, vehicle registration, color and plate, among others.

  1. Offenses committed by road transport passengers;
  2. Offenses that provide for the suspension of the CNH as a sanction – self-suspended
  3. For driving a vehicle with a color or characteristic change (art. 230, VII, CTB);
  4. When the driver has vehicle plates in disagreement with CONTRAN (art. 221, CTB);
  5. For driving a cargo vehicle without tare registration and other inscriptions provided for in the CTB (art. 230, XXI, of the CTB);
  6. Driver who does not register the vehicle within 30 days (art. 233, CTB);
  7. Driving without mandatory documents (CNH and CRLV – art. 232, CTB);
  8. Infringement of the driver for not canceling the registration of the vehicle that resulted in total loss, and is irrecoverable or permanently dismantled (art. 240, CTB); and
  9. Infringement for not updating the vehicle’s registration or license (art. 241, CTB).

CNH changes

In October, President Jair Bolsonaro announced new changes at the CNH. However, the text will only enter into force 6 months (180 days) after the publication of the law.

“Our intention is to cut red tape and make life easier for the driver,” said President Jair Bolsonaro.

The law sanctioned by Bolsonaro has 3 vetoes, including the provision that motorcyclists can only travel between vehicles only when traffic is stopped or slow.

According to the text, the Bill 3267/19, of the Executive Branch, the CNH will have valid for ten years for drivers with up to 50 years. The current five-year term continues for those over 50.

In the case of the renewal every three years, currently required for those over 65, it is valid only for drivers aged 70 and over.

Professionals who carry out paid activity in vehicles (bus or truck drivers, taxi drivers or drivers by request, for example) follow the general rule.

Regarding the score from which the citizen has the right to drive suspended, the project establishes a gradation of 20, 30 or 40 points in 12 months depending on whether there are serious infractions or not.

Currently, the suspension is given with 20 points, regardless of this type of infraction.

Now with the new rule:

  • the driver will be suspended with 20 points if he has committed two or more serious offenses;
  • with 30 points if he has a very serious infraction; and
  • with 40 points if he has not committed a serious offense in the previous 12 months.

Who performs paid work:

  • the suspension will be 40 points, regardless of the nature of the infractions;
  • the measure will apply to bus or truck drivers, taxi drivers, app drivers or motorcycle taxis.

However, if the paid driver wants to participate in a preventive recycling course when, in 12 months, he reaches 30 points, the total score will be reset. Currently, this possibility exists for those with portfolios type C, D or E if they accumulate 14 points.

New proposal: CNH free nationwide in 2020

A National driver’s license (CNH) It is expected to be issued by low-income people. The proposal is contained in the text of Draft Law (PL) No. 3,904 / 2019, written by Federal Deputy Emerson Miguel Petriv (PROS-PR).

The MP’s proposal aims for the card to be used for professional purposes. The idea is that the program reaches the entire national territory. Thus, the project clarifies that all the stages of issuing the document will be free, from the mandatory exams.

“For the poorest sectors of the population, National driver’s license – CNH it constitutes another opportunity to get a job, to develop an economic activity. However, with the requirements created by the current Traffic Code, the cost of classes, exams, driving vouchers and other administrative costs, has prevented this part of the population from accessing habilitation services ”, said the deputy.
