Following the determination of Minister Humberto Martins, president of the Superior Court of Justice, the dismissed mayor of Rio de Janeiro, Marcelo Crivella, was finally released from Benfica jail, on the night of this Wednesday (12/23).
After being detained preventively on Tuesday morning, the defense of the politician filed a Habeas Corpus in the STJ and, at the end of the day, the order was granted by Martins, who ordered the substitution of the preventive by house arrest, in addition to compliance precautionary measures. .
However, throughout this Wednesday, the mayor remained in detention. This is because the judge on duty at the Rio de Janeiro Court of Justice did not grant the release permit, he only referred the case to the trial judge in the Rio de Janeiro court, Judge Rosa Helena Penna Macedo Guita.
However, the magistrate did not issue the license either. Instead, he ordered a search, search and seizure warrant, so that phones, cell phones, computers and other communication devices could be removed from Crivella’s home. He also ordered landline and Internet companies to interrupt their signals and arrange for the politician to be braced.
Crivella’s defense, however, in the face of the stubbornness of the Rio de Janeiro court, had already made a new request to the STJ, which resulted in Martins’ determination to immediately release the agent.
