The judge of the Tianguá District granted, this Friday (18), to the couple Gabriela Fernandes, 23 years old, Thallys Lima, 28 years old, residents of Tinguá, the guard to begin living together for the purposes of four month baby adoption, after a favorable opinion of the Public Ministry of Ceará (MPCE). Six suitors those who were ahead of them in adoption dropped out and the couple became first in line.
After a favorable decision in the Ceará court, Gabriela and Thallys Lima used social networks on Friday night (18) to announce that they achieved judicial authorization and they are with their adopted son at home again.
“We came here to give you information, thank God, good information. We came here to thank God first. Everything in our lives is God. Secondly, we want to thank the couples who were moved by our situation, it was a key piece for us to be with our son today ”, highlights Thallys Lima.
Case
Between September and October of this year, Gabriela and Thallys from Ceará spent three weekends with a four-month-old baby, named by the couple as Santiago. After 20 days with the minor, the Ceará Justice determined, in October, that the adoption process was irregular and that they would have to return the baby to the foster care institution.
The couple applied for custody of the minor, but their application was rejected due to irregularities in their registration, since they were not formally qualified in the National Adoption System (SNA).
According to the Association of Magistrates of Cearense (ACM) the procedure for child liberation for the couple, in charge of the coordinator of the shelter, was “totally illegal, which happened in the absence and without the knowledge of the Judicial Power,” they point out in a note.
According to the coordinator of the Municipal Reception “Espaço Vida”, Marília Pinto de Carvalho, the permission to release the child from the shelter would have been produced based on an agreement between the Public Ministry of Ceará, the municipal shelter and the Justice Court of the State (ECJ), to facilitate the progress of the adoption. “We did everything accompanied by trained professionals, seeking to minimize this reception process,” he explains, stating that similar cases have previously occurred.
On Friday (18), after the Justice pointed out an irregularity in the adoption process, the Presiding Judge of the 3rd District Court of the municipality, Bruno dos Anjos, instituted a procedure to investigate possible irregularities carried out by the Reception coordinator Municipal, Marília Pinto de Carvalho. The Public Ministry of the State of Ceará (MPCE) will investigate if there was a favor to the adoption applicants by the shelter administrator.
