The Minister of the Federal Supreme Court (STF) Cármen Lúcia determined on Monday (14) that the Brazilian Intelligence Agency (Abin) and the Office of Institutional Security (GSI) of the Presidency of the Republic provide information, within 24 hours, on alleged reports prepared to guide the defense of Senator Flávio Bolsonaro (Republicans-RJ) in the case of the “crackers”.
According to Cármen Lúcia, the alleged production of the documents is “serious” and the court has consoling understandings that prohibit the use of public bodies for personal purposes.
The request for information is addressed to the minister of GSI, Augusto Heleno, and the general director of Abin, Alexandre Ramagem. In a joint note, the agencies said they “will wait for the notification and will respond within the term stipulated by Minister Carmen Lúcia.”

According to a report published in the magazine “Época” last Friday (11), Abin prepared at least two orientation reports for Flávio Bolsonaro and his lawyers on what must be done to obtain the documents that support a request for annulment of the case.
The magazine had already revealed, in October, that government agencies had acted to help the defense of Flávio Bolsonaro. The senator’s lawyers are trying to substantiate an accusation against a group of employees of the Federal Revenue Service, who have acted to feed the control bodies with confidential data on politicians, businessmen, officials, among others.
On Saturday, the Attorney General’s Office (PGR) reported that it included, in an investigation already underway in the body, the suspicions that Abin has reported to the lawyers.

The Abin reports described by “Época” would deal with an alleged criminal plan at the IRS to provide Flávio’s data to support the fractured investigation (salary diversion of cabinet employees).
According to the magazine “Época”, in these documents Abin:
- specifies the purpose of “defend FB [Flávio Bolsonaro] in the case of Alerj [Assembleia Legislativa do Estado do Rio de Janeiro]”;
- suggests replacing the “publications” in reference to the officials of the Federal Treasury, and
- draws up a “triple maneuver” to try to get the documents that Flávio’s defense is waiting for.
The authenticity and origin of the documents were confirmed to the magazine “Época” by the defense of the senator. According to the magazine, Abin’s reports were sent in September, via WhatsApp, to Flávio, who passed them on to his lawyers.
The Rio prosecutor denounced Flávio Bolsonaro, son of President Jair Bolsonaro, for an alleged fraud plan in the Rio Legislative Assembly when he was a state deputy. Fabrício Queiroz is suspected of having administered the alleged plan.

Cármen Lúcia analyzes an action by the Rede Sustentabilidade party that asks the Supreme Court to prohibit President Jair Bolsonaro, GSI and Abin from making any request to the Internal Revenue Service and Serpro about the “Queiroz Case” to the extent that there is no purpose public in the public and that the PGR is activated to investigate the conduct of the authorities in the case.
“It is necessary that this Eg. Cut back on actions to stop the potential unconstitutional behavior of public institutions. Society cannot be held hostage to the volunteerism of governments or public agents. The abuse of the state machinery to fulfill personal ends, especially when they are to prevent legitimate criminal actions in the presence of the political agent in power, is an attitude that contrasts with the democratic rule of law, ”says the party.
For the minister, the information is essential to analyze eventual developments in the case and that the STF prohibits the use of the machine for personal purposes.
“The image described by the author [Rede] of the request is serious. This Supreme Federal Court expressly affirmed, in the decision of the precautionary measure, the illegitimacy of using the machine or state organs to serve the private interests of any person ”, wrote the minister.
According to Cármen Lúcia, “in order to assess the requests submitted by the author, information is required from the Director General of the Brazilian Intelligence Agency and the Minister of the Office of Institutional Security on what is alleged in the petition.”
