The Brazilian Intelligence Agency (Abin) prepared at least two orientation reports for Flávio Bolsonaro and his lawyers on what must be done to obtain the documents that support a request for annulment of the Queiroz case. In the two documents, obtained by columnist Guilherme Amado, from Época magazine, and whose authenticity and origin were confirmed by the senator’s defense, Abin details the operation of the alleged criminal organization that operates in the Federal Revenue Service (RFB) , which, according to the suspicion of Flávio’s lawyers, would have carried out an illegal scrutiny of his fiscal data to provide the report that generated the investigation of cracking. Sent in September to Flávio and delivered by him to his lawyers, the documents contrast with a version of General Augusto Heleno, prime minister of the Institutional Security Office, who publicly stated that there was no government intelligence action after the senator’s defense. Take the complaint to Bolsonaro, him and Alexandre Ramagem, director of Abin, on August 25.

One of the documents is self-explanatory when defining the reason for that work. In a field titled “Purpose”, it cites: “Defend FB in the Alerj case by demonstrating the procedural nullity resulting from the unmotivated access to FB’s tax data”. The two documents were sent by WhatsApp to Flávio and delivered to his lawyer Luciana Pires.
Alexandre Ramagem’s first contact with the case was at a meeting in Bolsonaro’s office on August 25, when he received a request from Flávio’s lawyers requesting a special investigation to obtain documents supporting the suspicion that he had been targeted by income. Ramage kept the material, made a copy and returned it the following day to Luciana Pires, who returned to the Planalto Palace to collect the document, receiving guidance that she would present it to the Federal Revenue Service. Abin’s participation, from then on, would continue through these reports, sent to Flávio Bolsonaro, with guidance on what the defense should do.

In the first report, which specifies the purpose of “defending FB in the Alerj case”, Abin classifies it as a “line of action” to fulfill the mission: “Obtain, via Serpro, a ‘special investigation’, showing access previous demotivated (arapongagem) ”. The text then analyzes the difficulty in obtaining the data requested from the Treasury and, in a pattern that is maintained throughout the text, makes accusations to Treasury employees and former secretaries, such as Everardo Maciel.
“The difficulty in obtaining the special investigation (Tostes) and directly in Serpro is unreasonable because the mentioned rule is internal to the RFB at the time of the person responsible for the installation of the current criminal structure – Everardo Maciel. There is a possibility that the records are or are already being manipulated, now that those involved in the RFB already know the line that is being followed ”, says the report, referring to José Tostes Neto, head of Revenue.

The report suggests the replacement of the “posts”, probably referring to Treasury servers, and, without giving further details, states that this recommendation was already made in 2019.
“It is understood that the best course of action to address the FB problem, and especially the public interest, is to replace the positions according to the previous report. If the 2019 suggestion had been adopted, none of this would be happening, everyone involved would have been exchanged with little impact on the internal RFB process! ”Explains the text.
The agency then describes another “continuation alternative,” which would involve the Federal Comptroller General (CGU), the Federal Data Processing Service (Serpro) and the Federal Attorney General (AGU).

Still in this first document, two other federal officials are accused by Abin, the Federal Inspector General, Gilberto Waller Júnior, and the Internal Revenue Inspector, José Barros Neto.

“There are strong reasons to believe that the current CGU (Gilberto Waller Júnior) does not fulfill (ia) its official duty, since it is PART of the problem and has links with the Group, especially the misdeeds that it must scrutinize in the area of Corregedoria and society with BARROS NETO) ”, says the text.
A curious parenthesis. In this section, at the end of the document, Abin, commanded by PF delegate Alexandre Ramagem, suggests that Bolsonaro dismiss Waller Júnior from the Internal Affairs Division and put a federal policeman in his place: “In this case, only 01 (Bolsonaro) is in charge. exchange WALLER for another exempt CGU. For example, a former PF, preferably a former PF magistrate you trust ”.
The other document sent by Abin to Flávio and delivered by him to his lawyer traces a “triple maneuver” to try to get the documents that the defense awaits.

“Dr. Juliet (probable reference to lawyer Juliana Bierrenbach, also from Flávio’s defense) must visit Tostes, have a cup of coffee and inform that he will file the lawsuit demanding the access now required,” says the first of the three actions, described by Abin as “distraction”.
Then, the text suggests that the defense request the head of Serpro to provide a special investigation on the Income data, based on the Access to Information Law, which in fact would make the defense of Flávio Bolsonaro. Abin emphasizes that the request must be made in writing. “The e-sic (electronic system of the Access Law) should be avoided because it circulates in the CGU system and GILBERTO WALLER is part of the RFB network,” explained Abin.

And finally, the report suggests “neutralizing the support structure”, the removal of “three key elements within the RF criminal group”, which “must be removed in continenti”. “This dismissal is summarized in a coup by the Executive, since they occupy positions of the DAS. These elements weigh on behaviors that are incompatible with the positions they occupy, being the protagonists of several well-documented frauds, ”the text states, without specifying what these behaviors would be. And he mentions the names of three servants: again the corregedor José Barros Neto; the head of the Rio de Janeiro Revenue Intelligence Office, Cléber Homem; and the head of the Internal Revenue Office in Rio, Christiano Paes. In an indication that Bolsonaro may be following Abin’s recommendation against public officials, Paes called for his resignation last week.
Wanted, GSI denied the existence of the documents, even though it was informed that the authenticity of both had been confirmed by the defense of Flávio Bolsonaro, and maintained the version that he was not involved in the matter. Abin did not respond to inquiries about the origin of the allegations made in the reports, nor were more documents produced than the two obtained by the column. Alexandre Ramagem, director of the agency, is currently reincorporated in command of the Federal Police, if Bolsonaro is acquitted in the investigation that investigates whether he wanted to control the corporation by appointing Ramage, a friend of his children, to the leadership of PF.
