The Federal Council of the Brazilian Bar Association (OAB) filed a lawsuit with the Federal Supreme Court (STF) on Wednesday 9, pointing out the omission of the government of Jair Bolsonaro due to the delay in providing a definitive national immunization plan and ensuring the effective access. population to the vaccine against covid-19.
In this line, the OAB made different requests to the Court, among them the permission for the acquisition and supply of vaccines that already have registration in “renowned regulatory bodies abroad, regardless of the registration in Anvisa” and also for the use of funds recovered by Lava. Jet and other operations for the purchase of immunizers.
“Every day matters, every day that our vaccination and immunization campaign is not on the streets means hundreds, if not thousands, of Brazilian lives lost. We have no right of omission or even incompetence at this historic moment,” emphasized the president of the entity. , Felipe Santa Cruz, on video.
In the lawsuit filed before the Supreme Court, the OAB also requests the declaration of “full validity and applicability” of 13,979 / 2020, so that the vaccines approved by the health authorities of the United States, Europe, China and Japan can be used in Brazil in case of omission of Anvisa. to appreciate the order in 72 hours.
In making such a request, the OAB even highlighted a statement given by the agency in November that “an eventual approval of a vaccine by China’s regulatory authority does not imply an automatic approval for Brazil.”
Now, the agency’s statement directly confronts the provisions of the law to combat coronavirus (Law 13.979 / 2020), which categorically provides for the possibility of using vaccines in Brazil already approved by the regulatory agencies of the United States, the European Union, the Japan and China “.
The legal entity also wants the Supreme Court to determine that the federal government base the memorandums of understanding on the purchase of vaccines on “strictly technical and scientific tests, regardless of the national origin of the immunizer, that allow Brazilians to offer all vaccines that have they have reached advanced testing stages and have demonstrated the necessary safety and efficacy. “
“The immeasurable severity of the emergency situation caused by the coronavirus pandemic requires all Brazilian authorities, at their different levels of government, to specify the protection of public health and the guarantee of life and human dignity”, registers the ADPF.
