A federal appeals court in the United States on Friday rejected a request by President Donald Trump’s lawyers to block the certification of Joe Biden’s victory in the state of Pennsylvania. The certification was issued Tuesday and the president’s lawyers were trying to reverse it.
With the victory, Biden won all 20 state delegates to the Electoral College.
According to the verdict of Judge Stephanos Bibas, the Trump campaign allegations “have no merit.”
“Free and fair elections are the lifeblood of our democracy. The accusations of injustice are serious. But calling an election unfair doesn’t mean it is. The charges require specific indictments and then evidence. We don’t have any of these things here, ”says the ruling sent to a three-judge panel.
Still, Trump’s team has said it intends to appeal to the Supreme Court.
The case was discussed last week in a lower court by Trump’s attorney, Rudy Giuliani, who insisted during five hours of oral arguments that the 2020 presidential election was marked by widespread fraud in Pennsylvania. However, according to the Associated Press, Giuliani did not present any tangible proof of this in court.
Federal District Judge Matthew Brann said the campaign’s flawed complaint, “like Frankenstein’s monster, was stitched up at random” and denied Giuliani the right to change it a second time.
The United States Court of Appeals for the Circuit found that decision to be justified. All three judges on the panel were appointed by Republican presidents, including Bibas, a former Trump-appointed University of Pennsylvania law professor.
In a Twitter message, Trump again insisted on Friday that there was election fraud, this time questioning the more than 80 million votes received by his opponent.
“Biden can only enter the White House as president if he can show that his ridiculous” 80 million votes “were not obtained fraudulently or illegally. When you see what happened in Detroit, Atlanta, Philadelphia and Milwaukee, massive electoral fraud! You have a big problem with no solution! ”He wrote.
The post came a day after Trump said he would leave the White House if the Electoral College confirms Biden’s victory in the election, the closest yet to an admission of his Nov.3 defeat.
Shortly after, however, he added: “But I think a lot will happen between now and January 20. A lot,” he said. “Massive fraud has been discovered. We are like a Third World country.”
