The National Institute of Social Security (INSS) has held another to regret benefits paid by Social Security. According to lawyers specializing in social security law, it targets elderly retirees.

Approximately 1.7 million insured persons must be summoned for having some indication of irregularity in the receipt of INSS benefits. Who is notified has up to 60 days Present the documents that prove the right to the benefit. Otherwise, the income can be suspended and even blocked by the agency.

However, there are cases where the government requires the submission of documents older than five decades. This makes it difficult for older people to meet the requirement on time, since many times the insured person no longer has the document in hand and finds it difficult to obtain a duplicate in the midst of the new coronavirus pandemic.

The president of the Brazilian Institute of Social Security Law (IBDP) even claims that the INSS only has ten years to review benefits, except when fraud is suspected. However, the professional says that many pensioners who had the benefit granted decades ago are being notified.

The INSS, in turn, says that the calls are related to “the pending registration, not entering, at this time, the rules of law that generated the benefit.”

How to send the documentation?

The president of the IBDP explains that it is essential to comply with the request and present the documentation in hand. In case it is impossible to send any required document, the lawyer advises to look for it in public bodies. Another option is to make a declaration of compliance with the requirement to the INSS, indicating that it no longer has anything.

Depending on the agency, sending the requested documentation can be done through the My INSS website or application. It is also possible to regularize the situation in any of the INSS branches, as long as a prior appointment is made by 135. Bear in mind that the delivery of documents can be carried out by third parties expressly. In this case, the documentation must be deposited in ballot boxes installed at the doors of the branches with the programming data.

The INSS also indicates that the requested documents can be submitted by simple copies. This is because Ordinance No. 892, of September 3, 2020, “dispenses with the presentation of original documents necessary for updating the National Registry of Social Information (CNIS) and the analysis of requirements for benefits and services.”
