The Federal District Court for Children and Youth (VIJ-DF) determined, on Friday (23), the return of face-to-face classes in the capital’s public network within 20 days. According to the decision, the Federal District Government has five days to present a resumption plan.

Until the last update of this report, the GDF had not commented on the determination. In early October, Education Secretary Leandro Cruz said public schools would only resume classroom activities in 2021.

Face-to-face classes in public schools have been suspended since March 12 due to the new coronavirus pandemic. The school year resumed in July, with video classes and the delivery of printed material to students who do not have internet or electronic equipment necessary for remote activities (remember below).

The decision is signed by Judge Renato Scussel, in an action filed by the Public Ministry of the Federal District, who defended the resumption of classes in all schools, including kindergartens. When ruling on the issue, the judge mentions that activities in the private network have already been resumed, in addition to other economic sectors.

“[…] Private schools have already reopened and have returned to their activities as well as commerce, places of religious worship and there is authorization for public actions, it is not fair or legal that, in a country without education, children and adolescents who use the system of public education are restricted in their primary right to education ”, said the magistrate.

The judge also highlighted articles of the Federal Constitution that guarantee the right to education. “Under this approach, the right aims to provide the State with a view to guaranteeing the resumption of face-to-face classes for all children and adolescents in the public education system of the Federal District, ensuring the primary right to education,” he said. . .

In July, the Department of Education even announced a schedule to resume face-to-face activities, which would begin on August 31. However, a few days before the date, the portfolio suspended the measure indefinitely.

In private schools, classes were resumed on September 21, after an agreement between teachers represented by the union, companies and the Public Ministry of Labor.

In early October, the Secretary of Education, Leandro Cruz, said that face-to-face classes would only resume next year.

“We will also ensure that, in 2021, when we return to classes in person, we will return safely. The new normal that is there will be maintained. The habit of washing hands, cleaning schools, having a more careful routine,” said Leandro.
